THE LOCAL GOVERNMENT (PLANNING AND DEVELOPMENT) ACT, 1976, (COMMENCEMENT) ORDER, 1977.

The Minister for Local Government, in exercise of the powers conferred on him by subsection (3) of section 46 of the Local Government (Planning and Development) Act, 1976 , (No. 20 of 1976), hereby orders as follows:—

1. This Order may be cited as the Local Government (Planning and Development) Act, 1976 , (Commencement) Order, 1977.

2. In this Order—

"the Act" means the Local Government (Planning and Development) Act, 1976 .

3. On the 15th day of March, 1977—

(a) sections 14, 15, 16, 17, 18, 19, 20, 23, 24, 32, 33, 34, 35, 42 and 44 of the Act shall come into operation;

(b) subsections (1) and (2) of section 21 of the Act shall come into operation;

(c) section 39 of the Act shall come into operation for the purpose of effecting the amendments set out in paragraphs (a), (b), (d), (e), (g) and (l) of that section;

(d) section 41 of the Act shall come into operation for the purpose of effecting the amendments set out in paragraphs (b) and (d) of that section;

(e) subsection (1) of section 43 of the Act shall come into operation for the purpose of effecting the amendments set out in paragraphs (b), (i) and (j) of that subsection and subsection (2) of section 43 of the Act shall come into operation.

EXPLANATORY NOTE.

This Order brings into operation on 15th March, 1977, the provisions of the Local Government (Planning and Development) Act, 1976 , not already in operation, being mainly those provisions relating to the transfer of appellate functions from the Minister to An Bord Pleanála.
