MAXIMUM PRICES (KEROSENE) (No. 2) ORDER, 1976.

The Minister for Industry and Commerce, in exercise of the powers conferred on him by sections 22A and 22C (inserted by the Prices (Amendment) Act, 1965 (No. 23 of 1965)) of the Prices Act, 1958 (No. 4 of 1958), as amended pay the Prices (Amendment) Act, 1972 (No. 20 of 1972), and the Prices Stabilisation Order, 1973 ( S.I. No. 96 of 1973 ), hereby orders as follows:

1. This Order may be cited as the Maximum Prices (Kerosene) (No. 2) Order, 1976.

2. This Order shall come into operation on the 28th day of June, 1976.

3. The maximum price at which Kerosene (paraffin oil) may be sold by retail shall be a price calculated at the rate of 35½p per gallon.

4. It shall be a defence in a prosecution for an offence under this Order to show—

( a ) that the kerosene (paraffin oil) in relation to which the prosecution is brought was purchased by the retailer from Burmah Castrol (Ireland) Limited, Conoco (Ireland) Limited, Irish Shell Limited, or Esso Teoranta, or from an authorised agent or distributor of any of those companies, and

( b ) that the price at which the retailer sold the kerosene (paraffin oil) did not exceed a price calculated at the rate of 36½ per gallon.

5. The Maximum Prices (Kerosene) Order, 1976 ( S.I. No. 19 of 1976 ), is hereby revoked.

EXPLANATORY NOTE.

This Order fixes the maximum retail price at which kerosene (paraffin oil) may be sold by retail.
