ROAD TRAFFIC (CONSTRUCTION, EQUIPMENT AND USE OF VEHICLES) (AMENDMENT) REGULATIONS, 1974.

The Minister for Local Government in exercise of the powers conferred on him by sections 5 and 11 of the Road Traffic Act, 1961 (No. 24 of 1961) hereby makes the following Regulations :—

1. (1) These Regulations may be cited as the Road Traffic (Construction, Equipment and Use of Vehicles) (Amendment) Regulations, 1974.

(2) These Regulations and the Road Traffic (Construction, Equipment and Use of Vehicles) Regulations, 1963 to 1971, shall be construed together as one Regulation and may be cited together as the Road Traffic (Construction, Equipment and Use of Vehicles) Regulations, 1963 to 1974.

2. Article 80 of the Road Traffic (Construction, Equipment and Use of Vehicles) Regulations, 1963 ( S.I. No. 190 of 1963 ) as amended by article 2 of the Road Traffic (Construction, Equipment and Use of Vehicles) (Amendment) Regulations, 1967 ( S.I. No. 273 of 1967 ) is hereby amended by the substitution for sub-article (2) thereof of the following :—

"(2) In calculating the number of passengers being carried on a vehicle, the number of children who are passengers shall be reduced by one-third if—

( a ) the children are under the age of fifteen and not less than three such children are being carried, or

( b ) the vehicle is for the time being used exclusively for the carriage of passengers who are children, or children and teachers, going to or coming from school or school-related physical education activities ".

EXPLANATORY NOTE.

These Regulations extend to a wider usage of school transport, the principle already in operation whereby the number of passengers on large public service vehicles used for school transport may be calculated on the basis of three children to two adults.
