DISEASES OF ANIMALS ACT, 1966 (FIRST SCHEDULE) (AMENDMENT) ORDER, 1971.

I, JAMES GIBBONS, Minister for Agriculture and Fisheries, in exercise of the powers conferred on me by sections 3 and 11 of the Diseases of Animals Act, 1966 (No. 6 of 1966), hereby order as follows:

1. (1) This Order may be cited as the Diseases of Animals Act, 1966 (First Schedule) (Amendment) Order, 1971.

(2) The Order of 1968 and this Order may be cited together as the Diseases of Animals Act, 1966 (First Schedule) (Amendment) Orders, 1968 and 1971.

2. In this Order—

"the Act" means the Diseases of Animals Act, 1966 (No. 6 of 1966);

"the Order of 1968" means the Diseases of Animals Act, 1966 (First Schedule) (Amendment) Order, 1968 ( S.I. No. 231 of 1968 ).

3. For the purpose of extending the application of sections 3, 13, 30, 42, 46 and 51 of the Act and all other sections (including sections relating to offences and legal proceedings) containing provisions relative to or consequent on those sections, the First Schedule to the Act (as amended by the Order of 1968) is hereby amended by the insertion at the end of Part II thereof of the following:

"18. Birds of the order Passeriformes, including any of the birds commonly called finches, myna birds, thrushes, linnets and canaries.

19. Birds of the order Piciformes, including any of the birds commonly called toucans, kingfishers and woodpeckers."

4. Article 2 of the Order of 1968 shall be construed and have effect as if the reference to the sections of the Act therein mentioned included a reference to section 3 of the Act.

EXPLANATORY NOTE.

This Order extends the definition of "poultry" in the Diseases of Animals Act, 1966 as amended by the Diseases of Animals Act, 1966 (First Schedule) (Amendment) Order, 1968 to include birds of the orders Passeriformes (including finches, myna birds, thrushes, linnets and canaries) and Piciformes (including toucans, kingfishers and woodpeckers).
