AGRICULTURAL WORKERS (HOLIDAY REMUNERATION) ORDER, 1970 (AMENDMENT) ORDER, 1970.

The Agricultural Wages Board in exercise of the powers conferred on them by Section 17 of the Agricultural Wages Act, 1936 (No. 53 of 1936), and Section 5 of the Agricultural Workers (Holidays) Act, 1950 (No. 21 of 1950) and of every and any other power them in this behalf enabling, hereby order as follows:—

1. (1) This Order may be cited as the Agricultural Workers (Holiday Remuneration) Order, 1950 (Amendment) Order, 1970.

(2) This Order shall come into operation on the 6th day of April, 1970.

2. The Interpretation Act, 1937 (No. 38 of 1937), applies to this Order.

3. The Agricultural Workers (Holiday Remuneration) Order, 1950 ( S.I. No. 229 of 1950 ) is hereby amended by the substitution of the following paragraph for paragraph 4 thereof:

"4 (1) The minimum rate of holiday remuneration payable to an agricultural worker in respect of a holiday under the Act shall be the workers' normal daily wages in the period qualifying him for that holiday.

(2) The expression 'normal daily wages' means a sum equivalent to one-sixth of the worker's 'normal weekly wages'.

(3) The minimum rate hereby prescribed applies to all agricultural workers including the holders of permits under Section 18 of the Agricultural Wages Act, 1936 (No. 53 of 1936)."

4. Paragraph 5 (2) of the Agricultural Workers (Holiday Remuneration) Order, 1950 ( S.I. No. 229 of 1950 ) is hereby amended to read as follows:

"For the purposes of this Order the values of benefits or advantages for the time being prescribed shall apply to all agricultural workers including the holders of permits under Section 18 of the Agricultural Wages Act, 1936 (No. 53 of 1936)."

EXPLANATORY NOTE

The effect of this Order is

(a) to change the basis for calculating holiday remuneration from "average weekly earnings" to "normal weekly wages", and

(b) to delete from Paragraph 5 (2) of S.I. No. 229 of 1950 some wording which is no longer necessary. The wording provided that the values of benefits and advantages (board, lodging, etc.) for male workers under 17 years and not under 16 years should, for the purposes of calculating holiday remuneration, apply to all workers under 16 years. Benefits and advantages are however now prescribed for male and female workers in the 14—16 year group.
