AGRICULTURAL WORKERS (HOLIDAY REMUNERATION) ORDER, 1950.

The Agricultural Wages Board in exercise of the powers conferred on them by section 17 of the Agricultural Wages Act, 1936 (No. 53 of 1936), and section 5 of the Agricultural Workers (Holidays) Act, 1950 (No. 21 of 1950), and of every and any other power them in this behalf enabling, hereby order as follows :—

1. (1) This Order may be cited as the Agricultural Workers (Holiday Remuneration) Order, 1950.

(2) This Order shall come into operation on the commencement of the Act.

2. The Interpretation Act, 1937 (No. 38 of 1937), applies to this Order.

3. In this Order " the Act " means the Agricultural Workers (Holidays) Act, 1950 (No. 21 of 1950).

4. (1) The minimum rate of holiday remuneration payable to an agricultural worker in respect of a holiday under the Act shall be that worker's average daily earnings in the period qualifying him for that holiday.

(2) The expression " average daily earnings " means one-sixth of the worker's average weekly earnings.

(3) The minimum rate hereby prescribed applies to all agricultural workers, including the holders of permits under section 18 of the Agricultural Wages Act, 1936 (No. 53 of 1936).

5. (1) For the purpose of computing holiday remuneration, benefits or advantages provided for the worker by his employer shall be reckoned as payment of holiday remuneration in lieu of payment in cash to the same extent as they are to be reckoned as payment of wages in accordance with an order under the Agricultural Wages Act, 1936 , for the time being in force.

(2) For the purposes of this Order, the values of benefits or advantages for the time being prescribed for male agricultural workers shall apply to all agricultural workers including holders of permits, and the values prescribed for male workers under 17 years and not under 16 years shall apply to all workers under 16 years.

(3) Where a worker, instead of taking holidays which he is to be allowed under the Act, remains at work with his employer's consent, the said benefits and advantages may be reckoned as payment in lieu of payment in cash in respect either of wages or holiday remuneration but not in respect of both.

6. Where a worker for whom a minimum monthly or weekly rate of wages is prescribed takes a holiday in accordance with the Act, the minimum rate of wages for the period within which the holiday is taken shall be reduced by the amount of the holiday remuneration for that holiday.
