BRUCELLOSIS IN CATTLE (CONTROL OF VACCINATIONS) ORDER, 1966.

I, CHARLES J. HAUGHEY, Minister for Agriculture and Fisheries, in exercise of the powers conferred on me by Section 13 of the Diseases of Animals Act, 1966 (No. 6 of 1966), hereby order as follows :—

1. (1) This Order may be cited as the Brucellosis in Cattle (Control of Vaccinations) Order, 1966.

(2) This Order shall come into operation on the 1st day of September, 1966.

2. In this Order—

" animal " means a bovine animal ;

" anti-abortion vaccine " means any vaccine intended for use in the vaccination of an animal against brucellosis ;

" brucellosis ", except in Article 1, means brucellosis in cattle ;

" the Minister " means the Minister for Agriculture and Fisheries.

3. This Order shall not apply to an area for the time being declared by the Minister under section 19 of the Diseases of Animals Act, 1966 (No. 6 of 1966), to be an area in which brucellosis is to be eradicated.

4. No person other than a veterinary surgeon shall vaccinate any animal with anti-abortion vaccine.

5. (1) A female animal which is less than three months of age or more than six months of age or a male animal shall not be vaccinated with anti-abortion vaccine except with the permission in writing of the Minister.

(2) The Minister may in giving a permission under this Article specify in the permission any condition including a condition that a particular type of vaccine shall be used in the vaccination.

(3) A condition specified in any permission given under this Article shall be complied with.

6. (1) Where an identity card has been issued by the Minister in respect of a female animal proposed to be vaccinated with anti-abortion vaccine and the animal is neither less than three months nor more than six months of age, the owner or person in charge of the animal shall, before the vaccination is carried out, surrender to the person carrying out the vaccination the said identity card.

(2) The person carrying out the vaccination shall endorse each identity card surrendered to him in accordance with paragraph (1) so as to indicate both the date on which the animal was vaccinated and the type of vaccine used and shall return the identity card, when duly endorsed, to the owner or person in charge of the animal.

7. (1) Where an animal has been vaccinated with anti-abortion vaccine the following provisions shall have effect :

(a) the person carrying out the vaccination shall insert an approved ear-tag in the left ear of the animal, if the animal does not already bear an approved ear-tag ;

(b) the approved ear-tag shall bear the identification letter appropriate to the county in which the vaccination is carried out and a serial number ;

(c) the person carrying out the vaccination shall furnish to the Minister within seven days a report indicating the age and approved ear-tag number of the animal, the date of vaccination and the name, address and herd number under the Bovine Tuberculosis Eradication Scheme of the owner.

(2) No person shall alter or remove any ear-tag inserted pursuant to this Article or insert any ear-tag that could be confused with such ear-tag.

(3) In this Article—

" approved ear-tag " means an ear-tag which is—

(a) of a pattern approved by the Minister,

(b) such that when inserted in the ear of the animal it becomes effectively closed and if subsequently removed, cannot be used again,

(c) such that, if identification letters or numbers borne by the ear-tag are altered (whether by addition, deletion or variation) the alteration is evident as such, and

(d) made of rigid durable material and is clearly legible ;

" Bovine Tuberculosis Eradication Scheme " means the scheme for the eradication of bovine tuberculosis which was initiated by the Minister in September, 1954.

8. The Diseases of Animals (Control of Certain Vaccinations and Extension to Brucellosis) Order, 1965 ( S.I. No. 111 of 1965 ), is hereby revoked.

EXPLANATORY NOTE.

This Order provides that in an area which is not a Clearance Area (1) vaccination of cattle with anti-abortion vaccine shall be carried out only by a veterinary surgeon (2) such vaccination, except with the permission of the Minister, shall be confined to heifer calves aged not less than three and not more than six months (3) where permission to vaccinate an animal is given it may include a condition that a particular type of vaccine shall be used (4) any identity card issued by the Minister in respect of a heifer calf aged not less than three and not more than six months shall be surrendered to the person carrying out the vaccination and (5) the person carrying out the vaccination shall record the vaccination on the identity card.

The Order revokes the Diseases of Animals (Control of Certain Vaccinations and Extension to Brucellosis) Order, 1965 ( S.I. No. 111 of 1965 ).
