DISEASES OF ANIMALS (CONTROL OF CERTAIN VACCINATIONS AND EXTENSION TO BRUCELLOSIS) ORDER, 1965.

I, CHARLES J. HAUGHEY, Minister for Agriculture, in exercise of the powers conferred on me by section 22 of the Diseases of Animals Act, 1894, hereby order as follows :—

1.—(1) This Order may be cited as the Diseases of Animals (Control of Certain Vaccinations and Extension to Brucellosis) Order, 1965.

(2) This Order shall come into operation on the 17th day of May, 1965.

2. In this Order—

"animal" means a bovine animal ;

"anti-abortion vaccine" means any vaccine intended for use in the vaccination of an animal against brucellosis ;

"the Minister" means the Minister for Agriculture.

3. No person other than a veterinary surgeon or a veterinary inspector shall vaccinate any animal with anti-abortion vaccine.

4. A female animal which is less than three months of age or more than six months of age or a male animal shall not be vaccinated with anti-abortion vaccine except with the permission in writing of the Minister.

5. Where an identity card has been issued by the Minister in respect of an animal proposed to be vaccinated, the owner or person in charge shall, before the vaccination is carried out, surrender to the veterinary surgeon or veterinary inspector carrying out the vaccination the said identity card.

6.—(1) Where an animal has been vaccinated with anti-abortion vaccine the following provisions shall have effect:

(a) the animal shall be marked immediately on completion of the vaccination by means of a tattoo in the right ear, unless it is a pedigree animal (that is to say, an animal registered in a herd book kept by any society, club or association of breeders),

(b) (i) the veterinary surgeon or veterinary inspector carrying out the vaccination shall insert an approved ear-tag in the left ear of the animal, if the animal does not already bear an approved ear-tag ;

(ii) the approved ear-tag shall bear the identification letter appropriate to the county in which the vaccination is carried out and a serial number ;

(c) in case the animal is required by this Article to be marked by means of a tattoo, the veterinary surgeon or veterinary inspector carrying out the vaccination shall apply the tattoo mark which shall consist of a numeral indicating the quarter of the year in which the vaccination was carried out, the letters "CV" in case the animal is not more than six months of age or the letters "AV" in any other case and a numeral indicating the year in which the vaccination was carried out,

(d) a tattoo mark applied pursuant to this Article shall, where possible, be applied so as not to overlap any tattoo mark already in the ear,

(e) the veterinary surgeon or veterinary inspector carrying out the vaccination shall furnish to the Minister within seven days a report indicating the age and approved ear-tag number of the animal, the date of vaccination and the name, address and herd number under the Bovine Tuberculosis Eradication Scheme of the owner.

(2) No person shall efface, obliterate, alter or remove any mark applied pursuant to this Article or apply any marking that could be confused with such marking.

(3) In this Article—

"approved ear-tag" means an ear-tag which—

(a) is such that when inserted in the ear of the animal it becomes effectively closed and if subsequently removed, cannot be used again,

(b) is such that, if identification letters or numbers borne by the ear-tag are altered (whether by addition, deletion or variation) the alteration is evident as such, and

(c) is made of rigid durable material and is clearly legible ;

"Bovine Tuberculosis Eradication Scheme" means the scheme for the eradication of bovine tuberculosis which was initiated by the Minister in September, 1954.

7. For the purposes of sections 4, 10, 13, 15, 19, 20, 22, 25, 43, 44, 56, 65 and 74 of the Diseases of Animals Act, 1894, as amended and extended by any subsequent enactments and all other sections (including sections relating to offences and legal proceedings) containing provisions relative to or consequent on the said sections the word "disease" shall be and is hereby extended so as to include "brucellosis."

EXPLANATORY NOTE.

This Order (1) provides that vaccination of cattle against brucellosis with anti-abortion vaccine may be carried out only by a veterinary surgeon or veterinary inspector, (2) restricts such vaccination, except with the permission of the Minister, to heifer calves aged not less than three months and not more than six months, (3) provides that each vaccinated animal (other than a pedigree animal) shall be marked in the right ear by means of a tattoo and (4) requires the surrender to the veterinary surgeon, or veterinary inspector carrying out the vaccination of any identity card issued by the Minister.
