SOCIAL WELFARE (OVERLAPPING BENEFITS) (AMENDMENT) REGULATIONS, 1960.

I, SEÁN MACENTEE, Minister for Social Welfare, in exercise of the powers conferred on me by Sections 3 and 32 of the Social Welfare Act, 1952 (No. 11 of 1952), hereby make the following regulations:—

1.—(1) These Regulations may be cited as the Social Welfare (Overlapping Benefits) (Amendment) Regulations, 1960.

(2) These Regulations and the Social Welfare (Overlapping Benefits) Regulations, 1953 to 1959, may be cited collectively as the Social Welfare (Overlapping Benefits) Regulations, 1953 to 1960.

2. These Regulations shall come into operation on the 5th day of August, 1960.

3. In these Regulations "the Principal Regulations" means the Social Welfare (Overlapping Benefits) Regulations, 1953 ( S.I. No. 14 of 1953 ).

4. Sub-article (4) of article 4 of the Principal Regulations as amended by article 4 of the Social Welfare (Overlapping Benefits) (Amendment) Regulations, 1957 ( S.I. No. 142 of 1957 ), is hereby amended by the substitution—

(a) in paragraphs (a), (c) and (d) for the words "eight" and "fifteen", where they occur, of the words "nine" and "seventeen", respectively;

(b) in paragraph (b) for the words "fifteen" and "seven shillings and sixpence" of the words "seventeen" and "eight shillings and sixpence", respectively;

(c) in paragraph (d) of the words "four shillings" for the words "a rate equal to one half of the weekly rate of the pension".

5. In determining the weekly rate of the pension for the purposes of paragraphs (b) and (d) of sub-article (4) of article 4 of the Principal Regulations there shall be excluded in the case of a widow with more than two qualified children three shillings and sixpence in respect of each such child in excess of two.

6. Sub-article (5) of article 4 of the Principal Regulations, as amended by article 3 of the Social Welfare (Overlapping Benefits) (Amendment) Regulations, 1959 ( S.I. No. 131 of 1959 ), is hereby amended—

(a) by the substitution for the words "forty-one shillings", "forty-nine shillings", and "fifty-seven shillings" of the words "forty-two shillings", "fifty-one shillings" and "fifty-nine shillings" respectively; and

(b) by the deletion of the words "or more" in paragraph (iii) of the sub-article and by the addition at the end thereof of the words "which sum shall be increased by three shillings and sixpence in respect of each qualified child in excess of two".

EXPLANATORY NOTE.

The Social Welfare (Miscellaneous Provisions) Act, 1960 , makes provision for increases in the rates of widows' (non-contributory) pensions. These Regulations provide for consequential increases in the limits prescribed in the Social Welfare (Overlapping Benefits) Regulations, 1953 ( S.I. No. 14 of 1953 ), as amended, to the combined rate payable by way of pension and disability benefit or unemployment benefit to a widow who is in receipt of a widow's (non-contributory) pension which is reduced in respect of means. The Regulations also make consequential adjustments in the allocations in respect of children.
