SOCIAL WELFARE (OVERLAPPING BENEFITS) (AMENDMENT) REGULATIONS, 1957.

I, PATRICK SMITH, Minister for Social Welfare, in exercise of the powers conferred on me by sections 3 and 32 of the Social Welfare Act, 1952 (No. 11 of 1952), hereby make the following regulations :—

1.—(1) These Regulations may be cited as the Social Welfare (Overlapping Benefits) (Amendment) Regulations, 1957.

(2) These Regulations and the Social Welfare (Overlapping Benefits) Regulations, 1953 to 1956, may be cited collectively as the Social Welfare (Overlapping Benefits) Regulations, 1953 to 1957.

2. These Regulations shall come into operation on the 5th day of July, 1957.

3. In these Regulations "the Principal Regulations" means the Social Welfare (Overlapping Benefits) Regulations, 1953 ( S.I. No. 14 of 1953 ).

4. Sub-article (4) of article 4 of the Principal Regulations as amended by article 4 of the Social Welfare (Overlapping Benefits) (Amendment) (No. 2) Regulations, 1955 ( S.I. No. 145 of 1955 ), is hereby amended by the substitution—

(a) in paragraphs (a), (c) and (d) for the words " seven " and " fourteen ", where they occur, of the words " eight " and " fifteen ", respectively;

(b) in paragraph (b) for the words " fourteen " and " seven shillings " of the words " fifteen " and " seven shillings and sixpence ", respectively.

5. Sub-article (5) of article 4 of the Principal Regulations is hereby amended by the substitution for the words " thirty-seven shillings and sixpence ", " forty-five shillings and sixpence " and " fifty-three shillings and sixpence " (being the words substituted therein by article 4 of the Social Welfare (Overlapping Benefits) (Amendment) Regulations, 1956 ( S.I. No. 225 of 1956 )), of the words " thirty-eight shillings and sixpence ", " forty-six shillings and sixpence " and " fifty-four shillings and sixpence ", respectively.

Explanatory Note.

The Social Welfare Act, 1957 makes provision for increases in the rates of widow's (non-contributory) pensions. These Regulations provide for consequential increases in the limits prescribed in the Social Welfare (Overlapping Benefits) Regulations, 1953 ( S.I. No. 14 of 1953 ), as amended, to the combined rate payable by way of pension and disability or unemployment benefit to a widow who is in receipt of a widow's (non-contributory) pension which is reduced in respect of means. The Regulations also make consequential adjustments in the allocations in respect of children.
