S.I. No. 58 of 1959.

GENERAL BYE-LAWS FOR THE CONTROL OF TRAFFIC, 1937 (AMENDMENT) BYE-LAWS, 1959.

I, DANIEL COSTIGAN, Commissioner of the Garda Siochána, in exercise of the powers conferred on me by subsection (1) of section 147 of the Road Traffic Act, 1933 (No. 11 of 1933), hereby with the consent of the Minister for Local Government, make the following bye-laws :

1. (1) These Bye-laws may be cited as the General Bye-laws for the Control of Traffic, 1937 (Amendment) Bye-laws, 1959.

(2) The General Bye-laws for the Control of Traffic, 1937 and 1956, and these Bye-laws shall be construed together as one and may be cited together as the General Bye-laws for the Control of Traffic, 1937 to 1959.

2. In these Bye-laws, " the Principal Bye-laws " means the General Bye-laws for the Control of Traffic, 1937 ( S. R. & O. No. 222 of 1937 ), as amended by the General Bye-laws for the Control of Traffic, 1937 (Amendment) Bye-laws, 1956 ( S.I. No. 316 of 1956 ).

3. Bye-law 3 of the Principal Bye-laws is hereby amended by the insertion in paragraph (1) in the definitions of " pedestrian crossing " and " authorised sign " of " as amended by the Traffic Signs (Amendment) Regulations, 1959," after " Traffic Signs Regulations, 1956,".

4. Bye-law 7 of the Principal Bye-laws is hereby amended by the insertion of the following subparagraph after subparagraph (d) of paragraph (2) :

" (dd) the driver of a vehicle (other than a pedal bicycle) shall not stop the vehicle within thirty feet from the approach side of an uncontrolled pedestrian crossing (as defined in paragraph (1) of Bye-law 9 of these Bye-laws as amended by Bye-law 5 of the General Bye-laws for the Control of Traffic, 1937 (Amendment) Bye-laws, 1959) except to yield the right of way to a pedestrian on such crossing ;".

5. Bye-law 9 of the Principal Bye-laws is hereby amended by the insertion at the end of subparagraph (b) of paragraph (1) of the following :

" and which is indicated by roadway markings and beacons emitting flashes of yellow light as provided for in Article 9 of the Traffic Signs Regulations, 1956 ( S.I. No. 284 of 1956 ), as amended by the Traffic Signs (Amendment) Regulations, 1959 ".

6. The Principal Bye-laws are hereby amended by the insertion of the following Bye-law after Bye-law 16 :

" 16A. A pedestrian shall not cross a roadway outside, and within fifty feet from, a pedestrian crossing."

WHEREAS in pursuance of section 8 of the Road Traffic Act, 1933 , the Commissioner has submitted the foregoing bye-laws to the Minister for Local Government ; AND WHEREAS the provisions of subsection (1) of section 8 have been complied with in relation to the said bye-laws ; NOW THEREFORE the Minister for Local Government in exercise of the power conferred on him by section 147 of the said Act hereby consents to the making of the said bye-laws.

EXPLANATORY NOTE.

These Bye-laws amend the undermentioned Bye-laws of the General Bye-laws for the Control of Traffic, 1937, (Amendment) Bye-laws, 1956.

The amendments are :—

(1) Bye-law 3 is amended to bring it into line with the definitions of " pedestrian crossing " and " authorised sign " in the Traffic Signs (Amendment) Regulations, 1959.

(2) Bye-law 7 is amended to prohibit the stopping of vehicles (other than pedal bicycles) within 30 feet from the approach side of an uncontrolled pedestrian crossing, except to yield the right of way to a pedestrian on such crossing.

(3) Bye-law 9 (1) (b) is amended to make it clear that pedestrians have right of precedence only at pedestrian crossings which have yellow flashing beacons and zebra markings.

(4) Bye-law 16 is extended to prevent pedestrians crossing the roadway outside of, and within fifty feet from, a pedestrian crossing.
