GENERAL BYE-LAWS FOR THE CONTROL OF TRAFFIC, 1937 (AMENDMENT) BYE-LAWS, 1956.

I, DANIEL COSTIGAN, Commissioner of the Garda Síochána, in exercise of the powers conferred on me by subsection (1) of section 147 of the Road Traffic Act, 1933 (No. 11 of 1933), hereby, with the consent of the Minister for Local Government, make the following bye-laws :

1.—(1) These bye-laws may be cited as the General Bye-laws for the Control of Traffic, 1937 (Amendment) Bye-Laws, 1956.

(2) The General Bye-Laws for the Control of Traffic, 1937 ( S. R. & O. No. 222 of 1937 ), and these bye-laws may be cited together as the General Bye-Laws for the Control of Traffic, 1937 and 1956.

2. Each bye-law of the General Bye-Laws for the Control of Traffic, 1937 ( S. R. & O. No. 222 of 1937 ), mentioned in the first column of the Schedule to these bye-laws is hereby amended in the manner indicated in the second column of that Schedule opposite the mention of such bye-law.

SCHEDULE.

How Amended

Bye-law 3

1. The following shall be substituted for the definition of " controlled road junction " in paragraph (1) : " `controlled road junction ' means a road junction at which the traffic is for the time being controlled by a member of the Garda Síochána or by mechanical signals as prescribed in Regulation 14 of the Traffic Signs Regulations, 1956,".

2. The following shall be substituted for the definition of " pedestrian crossing " in paragraph (1) : " `pedestrian crossing ' means a crossing for pedestrians on a roadway which is indicated by means of traffic signs as prescribed in Regulation 9 of the Traffic Signs Regulations, 1956, but where there is a traffic refuge (as defined in Regulation 2 of the said Regulations) on a roadway, the following provisions shall have effect—

(a) the crossing shall not include the portion of the roadway occupied by the traffic refuge, and

(b) the parts of the crossing on each side of the traffic refuge shall each be deemed to be a separate crossing,".

3. The following shall be substituted for the definition of " authorised sign " in paragraph (1) :

" `authorised sign ' means any traffic sign as prescribed in the Traffic Signs Regulations, 1956, (or as otherwise authorised by the Minister for Local Government under section 69 of the Local Government Act, 1946 (No. 24 of 1946), as amended by section 36 of the Local Government Act, 1955 (No. 9 of 1955)) provided by the council charged with the maintenance of a roadway."

Bye-law 4

4. Subparagraph (a) of paragraph (2) shall be deleted.

5. In subparagraph (b) of paragraph (2) the words " there is no such authorised sign and " shall be deleted.

Bye-law 7

6. The following subparagraph shall be substituted for subparagraph (g) of paragraph (2) :

" (g) whenever the driver of a vehicle stops the vehicle either in compliance with a traffic control signal given by a member of the Garda Síochána or by mechanical signals, as prescribed in the Traffic Signs Regulations, 1956, or for the purpose of yielding, in compliance with these bye-laws, the right of way to other traffic or to pedestrians—

(i) the driver shall stop the vehicle at the stop-line (if any) provided,

(ii) where there is no stop-line provided, the driver shall not stop the vehicle on a pedestrian crossing or in such position or manner as to obstruct or impede a pedestrian crossing ;

How Amended

(h) the driver of a vehicle shall, when approaching a road junction at which a stop sign (as prescribed in Regulation 6 of the Traffic Signs Regulations, 1956) is provided on his left or near side of the road, stop the vehicle at the stop-line provided or, where there is no stop-line provided, at or near the stop-sign."

Bye-law 9

7. The following paragraph shall be substituted for paragraph (1) :

" (1) (a) At an uncontrolled pedestrian crossing every pedestrian on the roadway within the limits of such crossing shall have right of way within those limits over any vehicle, and the driver of any vehicle shall yield such right of way to a pedestrian if the pedestrian is on the roadway before the vehicle or any part thereof has come on to such crossing.

(b) In this paragraph ` uncontrolled pedestrian crossing ' means a pedestrian crossing at which the traffic is not for the time being controlled by a member of the Garda Síochána or by mechanical signals as prescribed in Regulation 14 of the Traffic Signs Regulations, 1956."

Bye-law 10

8. In paragraph (1) the following subparagraphs shall be substituted for subparagraph (a) :

" (a) shall, before reducing the speed of or stopping such vehicle, give the signal stated at reference number 1 in the Table of Signals at the end of this bye-law, and

(aa) shall, before turning such vehicle to the left, give the appropriate signal stated at reference number 1 (a) in the said Table of Signals, and".

9. In Part I of the Table of Signals at the end of the bye-law the following shall be substituted for the matter contained at reference number 1 :

" 1.

I am going to slow down or stop.

Extend the right arm and hand fully with the palm turned downwards and move the arm slowly upwards and downwards.

I(a)

I am going to turn to my left.

In the case of a vehicle other than a motor cycle or a pedal bicycle, extend the right arm and hand to the right and rotate in an anti-clockwise direction.

In the case of a motor cycle or a pedal bicycle, extend the left arm and hand fully to the left with the palm to the front and hold them rigid in a horizontal position straight out from the left side."

Bye-law 12

10. The following paragraph shall be substituted for paragraph (2) :

" (2) The illumination of the several lights constituting a mechanical signal erected under this bye-law for the control of traffic shall operate and have effect as signals having the following significance :

(a) the illumination of a red light shall be a signal prohibiting the stream of traffic controlled by such signal from proceeding beyond the stop-line on the roadway in front of such signal or beyond the signal if there is no stop-line on the roadway ;

(b) the illumination of an amber light simultaneously with a red light shall indicate an impending occulation of the red light but shall not alter the prohibitory effect of the illumination of the red light ;

(c) the illumination of a green light shall be a signal that the stream of traffic controlled by such signal may proceed past such signal ;

(d) the illumination of an amber light alone shall be a signal permitting any portion of the stream of traffic controlled by such signal which is, at the beginning of the illumination of such amber light—

(i) where there is a stop-line on the roadway in front of such signal, so close to that line that it cannot safely stop before crossing that line, to proceed past such signal, but prohibiting all other portions of the said stream of traffic from proceeding beyond the said stop line, or

(ii) where there is no stop-line on the roadway in front of such signal, so close to the signal that it cannot safely stop before passing the signal, to proceed, but prohibiting all other portions of the said stream of traffic from proceeding past the said signal ;

(e) whenever such signal includes a green light in the form of an arrow, the illumination of such green light shall be a signal permitting any portion of the stream of traffic controlled by such signal to proceed in the direction indicated by the arrow but for no other purpose."

Bye-law 13

11. In paragraph (1), after " roadway " there shall be inserted " (other than a horse which is being led)."

Bye-law 15

12. In paragraph (1), after " not attached to any vehicle " there shall be inserted " except where such horse or horses are being led on the right-hand side of the road."

Bye-law 21

13. In paragraph (1) the words " at the side or on the surface of such road " shall be deleted.

WHEREAS in pursuance of section 8 of the Road Traffic Act, 1933 , the Commissioner has submitted the foregoing bye-laws to the Minister for Local Government ; AND WHEREAS the provisions of subsection (1) of section 8 have been complied with in relation to the said bye laws ; NOW THEREFORE the Minister for Local Government in exercise of the power conferred on him by section 147 of the said Act hereby consents to the making of the said bye-laws.

EXPLANATORY NOTE.

These bye-laws amend the General Bye-Laws for the Control of Traffic, 1937.

The principal amendments are :—

(1) A substituted definition of " controlled road junction " is provided. Traffic light signals are now erected under the provisions of the Local Government Acts, 1946-1955, and the Traffic Signs Regulations, 1956. (Amendment No. 1 in the Schedule.)

(2) A substituted definition of " pedestrian crossing " is provided. A pedestrian crossing must be indicated by signs as prescribed by the Traffic Signs Regulations, 1956. (Amendment No. 2 in the Schedule.)

(3) The substituted definition of " authorised sign " is directly related to the Traffic Signs Regulations, 1956. (Amendment No. 3 in the Schedule.)

(4) A driver stopping in compliance with either a Garda or traffic light signal, or for the purpose of yielding right of way, must stop at the " stop-line," but if a " stop-line " is not provided he must not stop on a pedestrian crossing or so as to obstruct or impede a pedestrian crossing.

A driver, before entering a road junction where there is a " stop-sign " on his left or near side, must stop at the " stop-line," or where there is not a " stop-line " at or near the " stop-sign." (Amendment No. 6 in the Schedule).

(5) At a pedestrian crossing which is not controlled by a Garda or traffic light signals, a pedestrian on such crossing has right of way over any vehicle. The driver of a vehicle is obliged to yield the right of way to a pedestrian who is on the roadway within the crossing before the vehicle has come on to the crossing. (Amendment No. 7 in the Schedule).

(6) Separate signals are required to be given by drivers before (a) slowing down or stopping, or (b) turning to the left. (Amendments Nos. 8 and 9 in the Schedule).

(7) At traffic light signals where there is not a " stop-line " on the roadway a driver who is required to stop must do so before passing the signal. (Amendment No. 10 in the Schedule).

(8) A horse not attached to a vehicle may be led on either side of the road. (Amendment No. 11 in the Schedule).

(9) A motor vehicle may overtake and pass on the left a horse which is being led on the right-hand side of the road. (Amendment No. 9 in the Schedule).

(10) There is an obligation to comply with authorised signs whether placed at the side, on the surface or over the roadway. (Amendment No. 13 in the Schedule).
