RATIONING OF YARN, CLOTH AND CLOTHING ORDER, 1947.

I, SEÁN F. LEMASS, Minister for Industry and Commerce, in exercise of the powers conferred on me by Article 31 of the Emergency Powers Order, 1939 (S. R. & O. No. 224 of 1939), as amended by the Emergency Powers (No. 173) Order, 1942 (S. R. & O. No. 166 of 1942) (which Orders are continued in force by the Supplies and Services (Temporary Provisions) Act, 1946 (No. 22 of 1946)), and of every and any other power me in this behalf enabling, hereby order as follows:—

1 Short title

1. This Order may be cited as the Rationing of Yarn, Cloth and Clothing Order, 1947.

2 Definitions

2. In this Order—

references to boys or girls shall be construed as not including references to infants;

the word "homespun" means a woven woollen fabric made wholly of handspun yarn;

the reference to a linear yard in column (3) of Part I of the First Schedule hereto at reference number 7 shall be construed as including a reference to the 38" trade yard as known in the woollen trade;

references to men shall be construed as including references to youths;

the expression "part homespun" means a woven woollen fabric made partly of handspun yarn;

the expression "the Principal Order" means the Emergency Powers (General Rationing Provisions) Order, 1944 (S. R. & O. No. 130 of 1944);

the expression "ration book" means a ration book issued under the Principal Order and marked with the words "General Ration Book, 1944 issue" or the words "Special Ration Book (Army) valid from the 1st June, 1947 to the 31st May, 1948,"

the expression "supplemental ration card" means a supplemental ration card issued under the Principal Order and containing coupons marked "K";

references to women shall be construed as including references to maids;

the word "wool" means the products of the covering of the pelt of the alpaca, camel, goat, hare, lamb, llama, rabbit, sheep, vicuna or yak.

3 Construction

3. This Order is supplemental to, and shall be construed as one with, the Principal Order.

4 Commencement

4. This Order shall come into operation on the 1st day of June, 1947.

5 Rationed articles for the purposes of the Principal Order

5.—(1) Subject to the provisions of this Article, each of the following articles shall be a rationed article for the purposes of the Principal Order, that is to say:—

(a) any article which is of a description specified in column (2) of Part I of the First Schedule hereto;

(b) any article (being an article which is made wholly or mainly of woven or of knitted fabric or which is wholly or mainly knitted, netted or crocheted) which is of a description specified in column (2) of Part II of the said First Schedule and is suitable for wear by men or boys;

(c) any article (being an article which is made wholly or mainly of woven or of knitted fabric or which is wholly or mainly knitted, netted or crocheted) which is of a description specified in column (2) of Part III of the First Schedule hereto and is suitable for wear by women or girls;

(d) any article (being an article which is made wholly or mainly of woven or of knitted fabric or which is wholly or mainly knitted, netted or crocheted) which is of a description specified in column (2) of Part IV of the First Schedule hereto and is suitable for wear by infants;

(e) any article (being an article made of fur) which is of a description specified in column (2) of Part V of the First Schedule hereto;

(f) any article (being an article which is made wholly or mainly of woven or of knitted fabric or which is wholly or mainly knitted, netted or crocheted) which is of a description specified in column (2) of Part VI of the First Schedule hereto.

(2) The Principal Order shall not apply to—

(a) any article of a description specified at reference numbers 1, 2, 3, 4, 5 or 6 of Part I of the First Schedule hereto which is also specified in Part I of the Second Schedule hereto, or

(b) any article of a description specified at reference numbers 7 or 8 of Part I of the First Schedule hereto which is also specified in Part II of the Second Schedule hereto, or

(c) any article of a description specified at any reference number in Parts II, III, IV, or V of the First Schedule hereto which is also of any of the descriptions specified in Part III of the Second Schedule hereto, or

(d) any second-hand article of a description specified at any reference number in Parts II, III, IV, V or VI of the First Schedule hereto if the article is sold by retail and the retail price is less than—

(i) in case the reference number is F 20, F 21, F 21A, F 32, D 6, or D 7 and the article is suitable for wear by a man, £3, or

(ii) in case the reference number is B 31, B 32, B 32A, D 6, or D 7 and the article is suitable for wear by a woman, £3, or

(iii) in case the reference number is F 31 and the article is suitable for wear by a man, £2, or

(iv) in case the reference number is B 17, and the article is suitable for wear by a woman, £2, or

(v) in any other case, £1.

and accordingly none of the said articles shall be a rationed article for the purposes of the Principal Order.

(3) In the subsequent Articles of this Order the expression "scheduled rationed article" means an article which is, by virtue of this Article, a rationed article for the purposes of the Principal Order.

6 Appropriate coupons

6.—(1) The coupons, forming part of a ration book or a supplemental ration card, marked "I", "J" or "K" shall be the coupons applicable to scheduled rationed articles and the said coupons shall be available for lawful use by a retail customer or a trader only during the period commencing on the 1st day of June, 1947 and ending on the 31st day of May, 1948.

(2) For the purposes of paragraphs (1) and (2) of Article II of the Principal Order and this Order, a credit voucher marked "46" or a coupon equivalent licence shall—

(a) as respects the supplying to and the obtaining by, during the period of four months commencing on the 1st day of June, 1947, a trader, who is a retailer, of scheduled rationed articles, or

(b) as respects the supplying to and the obtaining by, during the period of five months commencing on the 1st day of June, 1947, a trader, who is a wholesaler, of scheduled rationed articles, or

(c) as respects the supplying to and the obtaining by, during the period of six months commencing on the 1st day of June, 1947, a trader, who is a manufacturer, of scheduled rationed articles required as raw material for his manufacturing business,

be taken to be the equivalent of a number of the appropriate coupons equal to the number of coupons specified in such voucher or licence.

In this paragraph—

the expression "a credit voucher marked '46'" means a credit voucher issued before the 21st day of June, 1947, under Article 37 of the Principal Order and marked "46";

the expression "coupon equivalent licence" means a licence (not being a licence overprinted with the inscription "this licence will not be valid for the supply of rationed articles after 31st October, 1946") issued during the period beginning on the 1st day of June, 1946, and ending on the 31st day of May, 1947, under Article 13 of the Principal Order and headed with the words "coupon equivalent licence."

7 Appropriate number of the appropriate coupons for scheduled rationed articles

7.—(1) For the purposes of the Principal Order—

(a) the appropriate number of the appropriate coupons, as respects each rationed article of a description specified in column (2) of Part I of the First Schedule hereto at any reference number shall be the number of coupons mentioned in column (3) of the said Part I at the said reference number;

(b) the appropriate number of the appropriate coupons, as respects each rationed article (being an article which is made wholly or mainly of woven or of knitted fabric or which is wholly or mainly knitted, netted or crocheted) which is of a description specified in column (2) of Part II of the said First Schedule at any reference number and is suitable for wear by men or boys, shall be the number of coupons mentioned in column (3) or (4) (whichever is appropriate having regard to the size of the article) of the said Part II at the said reference number;

(c) notwithstanding subparagraph (b) of this paragraph, the appropriate number of the appropriate coupons, as respects any rationed article (being an article which is made of hand-woven woollen cloth) which is of a description specified in column (2) of Part II of the First Schedule hereto at reference number F 8, F 9, F 17, F 18, F 20, F 21, F 26, F 27, F 31, F 32, F 33, F 34 or F 38, and is suitable for wear by men or boys, shall be one-fourth of the number of coupons set out in column (3) or (4), whichever is appropriate having regard to the size of the article, of the said Part II at the said reference number, and for this purpose any fraction which is equal to or less than one-half shall be ignored and any greater fraction shall be treated as unity;

(d) the appropriate number of the appropriate coupons, as respects each rationed article (being an article which is made wholly or mainly of woven or of knitted fabric or which is wholly or mainly knitted, netted or crocheted) which is of a description specified in column (2) of Part III of the First Schedule hereto at any reference number and is suitable for wear by women or girls, shall be the number of coupons mentioned in column (3) or (4) (whichever is appropriate having regard to the size of the article) of the said Part III at the said reference number ;

(e) notwithstanding subparagraph (d) of this paragraph, the appropriate number of the appropriate coupons, as respects any rationed article (being an article which is made of handwoven woollen cloth) which is of a description specified in column (2) of Part III of the First Schedule hereto at reference number B 12, B 13, B 17, B 25, B 26, B 31, B 32, B 43, B 44 or B 48 and is suitable for wear by women or girls, shall be one-fourth of the number of coupons set out in column (3) or (4), whichever is appropriate having regard to the size of the article, of the said Part III at the said reference number, and for this purpose any fraction which is equal to or less than one-half shall be ignored and any greater fraction shall be treated as unity ;

(f) the appropriate number of the appropriate coupons, as respects each rationed article (being an article which is made wholly or mainly of woven or of knitted fabric or which is wholly or mainly knitted, netted or crocheted) which is of a description specified in column (2) of Part IV of the First Schedule hereto at any reference number and is suitable for wear by infants shall be the number of coupons mentioned in column (3) of the said Part IV at the said reference number ;

(g) the appropriate number of the appropriate coupons as respects each rationed article (being an article made of fur) which is of a description specified in column (2) of Part V of the First Schedule hereto at any reference number shall be the number of coupons mentioned in column (3) of the said Part V at the said reference number ;

(h) the appropriate number of the appropriate coupons, as respects any rationed article (being an article which is made wholly or mainly of woven or of knitted fabric or which is wholly or mainly knitted, netted or crocheted) which is of a description specified in column (2) of Part VI of the First Schedule hereto at any reference number, shall be the number of coupons mentioned in column (3) of the said Part VI at the said reference number ;

(i) notwithstanding subparagraph (a) of this paragraph, the appropriate number of the appropriate coupons, as respects a rationed article consisting of a suit length complete with trimmings for a man or boy and in relationto which the appropriate number of the appropriate coupons would, but for this subparagraph, be determined in accordance with subparagraph (a) of this paragraph, shall be the appropriate number of the appropriate coupons determined in accordance with subparagraph (b) or (c) (whichever is appropriate) of this paragraph in relation to such suit as if it were made up.

(2) Where—

(a) a rationed article of a description specified in column (2) of Part II or Part III or Part IV or Part V of the First Schedule hereto at any reference number also falls within a description specified in column (2) of the same Part at any other reference number, and

(b) the appropriate number of the appropriate coupons as respects that article specified at the said reference numbers differs,

that article shall, for the purposes of determining the appropriate number of the appropriate coupons as respects that article, be deemed to fall within the description specified at whichever of the said reference numbers there is set out the greater number of coupons.

8 Prohibition of over supply

8. Where a trader supplies to a retail customer a quantity of a scheduled rationed article in exchange for the appropriate number of the appropriate coupons, the trader shall not, in exchange for those coupons, supply to the retail customer any additional quantity of that scheduled rationed article or any other scheduled rationed article or any article which is a rationed article for the purposes of the Principal Order by virtue of the Rationing of Footwear Order, 1947.

9 Trader to make available for retail customers copies of Schedules to this Order

9. Every person who carries on a business in the course of which any scheduled rationed article is sold or offered for sale on or after the 1st day of June, 1947, shall keep a copy of the First and Second Schedules to this Order and shall upon the request of a retail customer produce such copy to such retail customer for his inspection.

10 Hiring of scheduled rationed articles

10. Where a scheduled rationed article is hired for a period not exceeding fourteen days, it shall, for the purposes of the Principal Order, be deemed not to be supplied or obtained.

11 Production of scheduled rationed articles

11.—(1) A person, who subjects goods (other than fur or lace) not belonging to him to any process the products whereof are scheduled rationed articles, shall, when the goods are delivered in pursuance of the contract, be deemed to supply only such scheduled rationed articles, if any, as were added by him.

(2) A person, who subjects fur or lace, not belonging to him, to any process whereby scheduled rationed articles are produced, shall be deemed to supply scheduled rationed articles when the goods are delivered in pursuance of the contract.

12 Existing contracts

12.—(1) Where before the 1st day of June, 1947, a contract, for the supply of a scheduled rationed article by a trader to a retail customer, has been entered into and the article has not actually been delivered to the retail customer before that date, the provisions of the Principal Order shall apply in respect of such supply.

(2) Notwithstanding paragraph (1) of this Article, where—

(a) before the 1st day of June, 1947, a contract, for the supply of a scheduled rationed article (being an article ordered to be made to measure) by a trader to a retail customer, has been entered into, and

(b) the article has not actually been delivered to the retail customer before that date, and

(c) there have been obtained in relation to the article by the trader from the retail customer before that date such number of coupons marked " C " and " D " as was appropriate in accordance with the Principal Order and the Emergency Powers (Rationing of Yarn, Cloth and Clothing) Order, 1946 (S. R. & O. No. 144 of 1946),

the provisions of the Principal Order shall not apply in respect of such supply.

(3) Where before the 1st day of June, 1947, a contract for the supply of a scheduled rationed article by a trader to another trader has been entered into and the article has not actually been delivered to the other trader before that date, the provisions of the Principal Order shall apply in respect of such supply.

13 Sales by public auction of scheduled rationed articles

13.—(1) Scheduled rationed articles belonging to traders shall not, save under permit granted by the Minister, be sold by public auction.

(2) Where at any sale by public auction any scheduled rationed article is sold, the auctioneer shall, notwithstanding that the seller is not a trader, obtain from the purchaser the appropriate number of the appropriate coupons and shall, not later than fourteen days after the date of the auction, send to the Minister the coupons so obtained and also a statement giving the description and quantity of such scheduled rationed article and the appropriate number of the appropriate coupons in respect thereof, and the provisions of the Principal Order and of any licence granted thereunder shall apply in relation to the supply of the scheduled rationed article as if the seller were a trader.

(3) Paragraph (2) of Article 12 of the Principal Order shall cease to apply in respect of scheduled rationed articles.

14 Special provisions in relation to certain coupons

14.—(1) Coupons marked " C " or " D " shall not be accepted by one trader from another trader after the 31st day of May, 1947, except the coupons were in transit by post to such first-mentioned trader on the said date.

(2) Coupons marked " C " or " D " shall not be surrendered under Article 37 of the Principal Order, after the 20th day of June, 1947.

15 Marking of certa in scheduled rationed articles

15. The producer of a scheduled rationed article made from homespun, part homespun or handwoven woollen cloth shall not sell (or agree or offer to sell or invite an offer to buy) the article unless there is marked thereon or on a suitable label affixed thereto—

(a) where the article is made from homespun or part homespun—the word " homespun," or

(b) where the article is made from handwoven woollen cloth—the word " handwoven."

16 Application of certain directions

16. Any direction given by the Minister under Article 15 of the Emergency Powers (General Rationing Provisions) Order, 1942 (S. R. & O. No. 171 of 1942), in relation to a scheduled rationed article shall be deemed to be a direction given by the Minister in relation to such article under Article 15 of the Principal Order.

17 Revocation of Order

17. The Order specified in column (2) of the Third Schedule hereto is hereby revoked.
