STATUTORY RULES AND ORDERS. 1945. No. 254.

CASTLEBAR DISTRICT PROBATE REGISTRY (COLLECTION OF FEES) REGULATIONS, 1945.

WHEREAS it is enacted by section 3 of the Public Offices Fees Act, 1879, as adapted by or under subsequent enactments, that the Minister for Finance may from time to time make, and when made revoke, alter, and add to, regulations for certain purposes respecting fees in any public office and amongst others for the purpose of determining the use of impressed or adhesive stamps, and regulating the use of stamps and prescribing the application thereof to documents from time to time in use, and requiring documents to be used for the purpose of such stamps, and that any such regulations so far as they relate to the office of any court of law shall be made with the consent of the Chief Justice :

AND WHEREAS the District Probate Registry at Castlebar is a public office and an office of a court of law within the meaning of the said Act :

AND WHEREAS by virtue of the Castlebar District Probate Registry (Collection of Fees) Order, 1945, fees payable in the said District Probate Registry at Castlebar are to be collected by means of stamps :

AND WHEREAS the District Probate Registries (Collection of Fees) Regulations, 1932 ( S. R. & O. No. 116 of 1932 ), apply to certain district probate registries therein named, but not to the District Probate Registry at Castlebar :

NOW, the Minister for Finance, in exercise of the powers conferred on him by section 3 of the Public Offices Fees Act, 1879, as adapted by or under subsequent enactments, and of every and any other power him in this behalf enabling, with the consent of the Chief Justice testified by his signature affixed hereto, hereby makes the following regulations :—

1. These Regulations may be cited as the Castlebar District Probate Registry (Collection of Fees) Regulations, 1945.

2. The Interpretation Act, 1937 (No. 38 of 1937), applies to these Regulations.

3. The District Probate Registries (Collection of Fees) Regulations. 1932 ( S. R. & O. No. 116 of 1932 ), as amended by the District Probate Registries (Collection of Fees) (Amendment) Regulations, 1933 ( S. R. & O. No. 118 of 1933 ), shall apply to the District Probate Registry at Castlebar in like manner as those Regulations apply to the several District Probate Registries named therein, and for the purpose of such application, the expression " District Probate Registries to which these regulations apply " where it occurs in the said Regulations, as amended as aforesaid, shall be construed and have effect as if it included the District Probate Registry at Castlebar.

4. These Regulations shall come into operation on the 16th day of October, 1945.
