SCHEDULE.

PRESCRIBED FORMS.

The Minister for Local Government and Public Health, in exercise of the powers conferred on him by Part III of the Slaughter of Animals Act, 1935 , and of all other powers conferred on him in that behalf, hereby makes the following Regulations, that is to say :—

1 Citation

1. These Regulations may be cited as the Slaughter of Animals (Slaughter Licence) Regulations, 1936.

2 Interpretation

2. The Interpretation Act, 1923 , shall apply for the purpose of the interpretation of these Regulations in the same manner in which it applies for the purpose of the interpretation of an Act of the Oireachtas.

3 Meaning of "the Act."

3. In these Regulations the expression " the Act " means the Slaughter of Animals Act, 1935 .

4 Form of application

4. An application for the grant of a slaughter licence shall be made to a sanitary authority in the form (Form S.L. 1) set out in the Schedule to these Regulations, and shall be accompanied by the particulars and declaration indicated in the said form.

5 Manner of application

5. An application by any person to a sanitary authority for slaughter licence shall be made by such person either—

(a) by delivering it to such sanitary authority, or

(b) by sending it by post in a prepaid envelope addressed to such sanitary authority.

6 Prescribed fee

6. The prescribed fee for the issue of a slaughter licence shall be five shillings.

7 Form of licence

7. Every slaughter licence shall be in the form (Form S.L. 2) set out in the Schedule to these Regulations.

8 Duties of issuing officer

8. Whenever a slaughter licence is granted by a sanitary authority to any person on an application under these Regulations, the officer of such authority by whom such slaughter licence is issued to such person shall complete the portion of the application expressed to be completed by him.

9 Keeping of applications

9.—(1) Every application to a sanitary authority for a slaughter licence shall be retained by such sanitary authority for purposes of record.

(2) The applications retained by a sanitary authority under this Article shall be kept in alphabetical order according to the names of the applicants.

10 Register of licences

10. A sanitary authority shall establish and keep a register of slaughter licences granted by them in the form (Form S.L. 3) set forth in the Schedule to these Regulations, and shall make in such register the entries indicated on the said form.

11 Keeping of particulars of revocations, disqualifications and suspensions

11.—(1) When a sanitary authority receives a notification of a revocation or of a revocation and disqualification made by a court under section 28 of the act either directly from such court or from the Minister, such notification shall be retained by the sanitary authority for purposes of record.

(2) The notifications retained by a sanitary authority under this Article shall be kept in alphabetical order according to the names of the holders of the slaughter licences to which such notifications relate.

(3) A copy of a resolution of a sanitary authority revoking or suspending a slaughter licence shall be attached to the application for such slaughter licence and retained by such sanitary authority for purposes of record.

12 Powers of inspection and investigation

12. A sanitary authority shall, at the request of a member of the Gárda Síochána or of a duly authorised officer of the Minister who wishes to inspect the register of slaughter licences kept by such sanitary authority under these Regulations, or any of the documents retained by such sanitary authority under these Regulations, admit such member or officer to the offices of such sanitary authority at any time while such offices are open for business, and shall there submit to such member or officer such register and documents and shall permit such member or officer to inspect such register and documents when so submitted.

13 Furnishing of information by sanitary authority

13.—(1) A sanitary authority shall furnish to any other sanitary authority or to a member of the Gárda Síochána or to a duly authorised officer of the Minister any information in relation to any slaughter licence issued by such sanitary authority which such other sanitary authority, member or officer shall require, and the sanitary authority shall also upon payment of a charge, subject to the provisions of this Article in relation to payment of a charge therefor, supply the like information to any other person who may show that he has a reasonable cause for requiring the same to be supplied to him.

(2) A sanitary authority may make a charge for the furnishing of information under this Article to any person other than a sanitary authority, a member of the Gárda Síochána, or a duly authorised officer of the Minister, but such charge shall not exceed one shilling for every slaughter licence in relation to which information is so furnished.

Where a revocation is annulled on appeal the " R " should be struck out in red ink, and a reference to the order made on appeal inserted in Column 9.

(b) Where the licence is suspended during the period of validity " S " should be inserted in this column, followed by the date when the period of suspension will expire.
