S.I. No. 417/2000 - District Court Districts and Areas (Amendment) and Variation of Days (Ballina, Ballycastle, Crossmolina and Killala) Order, 2000.


The Courts Service, in exercise of the powers conferred on it by section 26 of the Courts of Justice Act, 1953 (No. 32 of 1953), as amended by section 43 of the Courts (Supplemental Provisions) Act, 1961 (No. 39 of 1961), section 16 of the Courts Act, 1971 (No. 36 of 1971) and section 29 of the Courts Service Act, 1998 (No. 8 of 1998) and after consultation with the President of the District Court, hereby orders as follows:

1. (1) This Order may be cited as the District Court Districts and Areas (Amendment) and Variation of Days (Ballina, Ballycastle, Crossmolina and Killala) Order, 2000.

(2) This Order shall come into operation on 1st January, 2001.

2. The First Schedule to the District Court (Areas) Order, 1961 ( S.I. No. 5 of 1961 ) is hereby amended by—

(a) the deletion at reference number 180 of the matter in columns (2), (3), (4) and (5),

(b) the deletion at reference number 183 of the matter in columns (2), (3), (4) and (5),

(c) the substitution at reference number 171 for the matter in columns (4) and (5) of the following:

Ballina—

The area comprising the District Electoral Divisions of Addergoole, Ardagh, Ardnaree North, Ardnaree South Rural, Ard- naree South Urban, Ballina Rural, Ballina Urban, Ballynagoraher, Ballysakeery, Bunaveela, Carrowmore, Crossmolina North, Crossmolina South, Deel, Derry, Fortland, Kilfian South, Kilgarvan, Killala, Letterbrick, Mount Falcon, Rathoma and Sallymount in the county of Mayo.

Fourth Monday in each month at 10.30 a.m.

Second and Fourth Tuesday in each month at 10.30 a.m.

(d) the substitution at reference number 173 for the matter in column (5) of the following:

“The area comprising the District Electoral Divisions of Ballycastle, Beldergmore, Kilfian East, Kilfian West, Lackan North and Lackan South in the county of Mayo.”.

3. The Second Schedule to the District Court (Areas) Order, 1961 ( S.I. No. 5 of 1961 ) is hereby amended by—

(a) the deletion at reference number 156 of the matter in columns (2), (3), (4) and (5),

and

(b) the substitution at reference number 148 for the matter in columns (4) and (5) of the following:

Ballina—

The area comprising the District Electoral Divisions of Addergoole, Ardagh, Ard- naree North, Ardnaree South Rural, Ard- naree South Urban, Ballina Rural, Ballina Urban, Ballynagoraher, Ballysakeery, Bunaveela, Carrowmore, Crossmolina North, Crossmolina South, Deel, Derry, Fortland, Kilfian South, Kilgarvan, Killala, Letterbrick, Mount Falcon, Rathoma and Sallymount in the County of Mayo.

4. The Schedule to the District Court Areas (Amendment) Order, 1970 ( S.I. No. 161 of 1970 ), is hereby amended at reference number 3 by the deletion in column (4) of “Crossmolina,”, “Killala,”, “180,” and “183,”.

5. Business transacted in the District Court that is initiated and not completed before the coming into operation of this Order shall be continued and completed as if this Order had been in force at the time at which such business had been initiated.

EXPLANATORY NOTE.

This order provides for

(a) the amalgamation of the District Court Area of Crossmolina with the District Court Area of Ballina,

(b) the amalgamation of the District Court Area of Killala with the District Court Areas of Ballina and Ballycastle and

(c) the holding of sittings of the Ballina District Court exercising its summary and civil jursidiction on the fourth Monday in each month at 10.30 a.m. and on the second and fourth Thursday in each month at 10.30 a.m.
