ROAD TRAFFIC (SPEED LIMITS) (COUNTY BOROUGH OF CORK AND COUNTY OF CORK) REGULATIONS, 1994.

The Minister for the Environment in exercise of the powers conferred on him by sections 5 , 45 and 46 of the Road Traffic Act, 1961 (No. 24 of 1961) amended as regards the said section 46 by section 25 of the Road Traffic Act, 1968 (No. 25 of 1968) hereby makes the following Regulations:—

1 Citation.

1. These Regulations may be cited as the Road Traffic (Speed Limits) (County Borough of Cork and County of Cork) Regulations, 1994.

2 Commencement.

2. These Regulations shall come into operation on the 9th day of May, 1994.

3 Interpretation

3. In these Regulations save where the context otherwise requires—

"the Act" means the Road Traffic Act, 1961 ;

"built-up area speed limit" and "special speed limit" have the meanings respectively assigned to them in Part IV of the Act;

"distance" means distance as measured along the centre line of a road;

"National Road" means a road declared to be a National Road in the Local Government (Roads and Motorways) Act, 1974 (Declaration of National Roads) Order, 1977 ( S.I. No. 164 of 1977 ) and any reference to the number of such road shall be a reference to the number of such road shown in column 1 of the First Schedule or column 1 of the Second Schedule to the aforementioned Order;

"perimeter road" means a road on and along the roadway of which there runs the boundary of a county borough, an urban district or a town and shall be considered as being within such boundary for the purposes of these regulations;

"road" means a public road;

4 Built-up area speed limit

4. (1) Each of the roads described in the First Schedule to these Regulations is hereby declared not to be a public road in a built-up area for the purposes of section 45 of the Act.

(2) Each of the roads described in the Second Schedule to these Regulations is hereby declared to be a public road in a built-up area for the purposes of section 45 of the Act.

5 Special speed limit

5. Forty miles per hour shall be the speed limit for mechanically propelled vehicles on the roads specified in the Third Schedule to these Regulations.

6 Exceptions

6. There shall be excepted from the special speed limit prescribed in article 5 of these Regulations and from the built-up area speed limit the following:—

( a ) ambulances,

( b ) fire brigade vehicles, and

( c ) vehicles used by members of the Garda Síochána in the performance of their duties as such members.

7 Revocation

7. The Road Traffic (Speed Limits) (County Borough of Cork and County of Cork) Regulations, 1981 ( S.I. No. 457 of 1986 ) and the Road Traffic (Speed Limits) (County Borough of Cork and County of Cork) (Amendment) Regulations, 1992 ( S.I. No. 98 of 1992 ) are hereby revoked.

FIRST SCHEDULE.

Roads declared not to be public roads in a built-up area for the purposes of section 45 of the Act.

1. The following roads in the town of Bantry:—

( a ) Hospital Road, The Inchiclough Road, Fairy Lane, The Slippery Slat Road, Beach Road, The Rooska Road, The Newtown Road.

( b ) The Glengarriff Road (National Road N71) for a distance of 1,156 metres from the town boundary.

( c ) The Dromclogh Road for a distance of 825 metres south-west of the town boundary.

( d ) The Quarry Well Road between a point where the town boundary intersects the southern side of the road and a point 270 metres east of its junction with the Sheskin Road.

( e ) The Dromleigh Road between its junction with the Sheskin Road and a point 453 metres south of its junction with Scart Road.

( f ) The back road to the Hospital.

( g ) The Ropewalk and its continuation as the Scart Road between its junction with the Cork Road (National Road N71) and a point 635 metres south-west of its junction with the Dromleigh Road.

( h ) The Cork Road (National Road N71) between the town boundary and a point 503 metres west of its junction with the Square.

( i ) The Caherdaniel Road between the town boundary and a point 192 metres east of its junction with the Dromclogh Road.

( j ) The Sheskin Road between the town boundary and a point 551 metres south of its junction with Ardnageehy Road.

2. The following roads in the Urban District of Clonakilty:—

( a ) The Desert Road, The Flaxmill Road, The Rocky Road, The Lackenagobidane Road, The Cappeen Road.

( b ) The Skibbereen Road (National Road N71) between the urban district boundary and a point 41 metres west of its junction with the Ballineen Road.

( c ) The Ballineen Road between the urban district boundary and a point 325 metres north of its junction with the Skibbereen Road.

( d ) The Bog or Fairfield Road between the urban district boundary and a point 92 metres west of Fair Green.

( e ) The road connecting Lady's Cross with Clogheen Cross North.

( f ) Gravel Pit Road between its junction with the Ballineen Road and a point 307 metres north-west of its junction with the Skibbereen Road (National Road N71).

( g ) The Ballinaffrin Road between the urban district boundary and a point 565 metres north-west of its junction with Patrick Street.

( h ) The Shannonvale Road for a distance of 512 metres south of the point where the urban district boundary intersects the eastern side of the road.

( i ) The Tubbereen Road between a point where the urban district boundary intersects the north western side of the road and a point 93 metres north-east of the point where the said boundary intersects the southern side of the road.

( j ) The Ring Road between the urban district boundary and a point 46 metres south-east of its junction with the Tubbereen Road.

( k ) The Youghal Road between the urban district boundary and a point 55 metres east of its northern junction with Dispensary Hill.

( l ) The Ardfield or Snugborough Road between the urban district boundary and a point 46 metres south-east of its junction with the Clogheen Road.

( m ) The Fern Hill Road between the urban district boundary and a point 325 metres north of its junction with the Skibereen Road (National Road N71).

( n ) The Clogheen Road between the urban district boundary and a point 78 metres south of its junction with the Ardfield Road.

3. The following road in the Urban District of Cobh:—

The Cork Road (High Road) between the urban district boundary and a point 92 metres west of its junction with Spy Hill.

4. The following roads in the County Borough of Cork:—

( a ) The Dublin Road (National Road N8) for a distance of 823 metres east of the county borough boundary.

( b ) The Carrigrahane Road for a distance of 1828 metres from the point where the county borough boundary intersects the southern side of the road.

( c ) The South City Link Road between the county borough boundary and a point 100 metres south of its junction with the Bohereennamana Road.

( d ) The Southern Ring Route.

( e ) The New Mallow Road for a distance of 175 metres south east of the point where the county borough boundary intersects the southern side of the road.

5. The following road in the Urban District of Fermoy:—

The Mallow Road (National Road N73) between the urban district boundary and a point 137 metres west of its junction with Church Hill.

6. The following roads in the Urban District of Kinsale:—

( a ) The Compass Hill Road for a distance of 274 metres from its southern intersection by the urban district boundary.

( b ) The Innishannon Road between the urban district boundary and a point 23 metres north of its junction with Catholic Walk.

( c ) Barrack Street and its continuation northwards between the urban district boundary and a point 23 metres north of its junction with Catholic Walk.

( d ) The New Road for a distance of 640 metres from the urban district boundary.

( a ) The Peake Road for a distance of 10 metres south-east of its junction with the road to Aghavrin Cross.

( b ) The Rylane Road for a distance of 50 metres north-west of its junciton with the road to Aghabullogue Bridge.

( c ) The road at Aghabullogue Bridge for a distance of 100 metres from its junction with the Rylane Road.

( d ) St. Olan Place Estate Roads.

( e ) The road at Aghavrin Cross for a distance of 60 metres from its junction with the Peake Road.

2. The following roads at Allihies:—

( a ) The Ballydonegan-Reentrisk road between a point 228 metres south-west of its junction with the Back Road and a point 53 metres north of its junction with the Old Berehaven Copper Mines Road.

All roads in the area enclosed by a line commencing at a point on the Inishcarra Bridge Road 60 metres south of its junction with the Cork-Coachford road and drawn thence in straight lines successively to the following points—

( a ) a point on the Cork-Macroom road (National Road N22) 280 metres south-west of its junction with the Classes Road,

( b ) a point on the Maglin Road 484 metres north of the centre line of Maglin Bridge.

( c ) the point on the Model Farm Road where it intersects the boundary of the county borough of Cork,

( d ) the point on the Inchigaggin Road where it intersects the Cork-Macroom road (National Road N22),

( e ) a point on the Cork-Macroom Road (National Road N22) 105 metres north-west of its junction with the Leemount Bridge Road.

and thence in a straight line to the commencement point on the Inishcarra Bridge Road.

6. The following roads at Ballincurrig:—

( a ) The Rathcormack-Midleton road between a point 120 metres north-west of its junction with the Templebodan-Corbally North road and a point 300 metres south-east of that junction.

( a ) The Cork-Bantry road between a point 156 metres east of its junction with the Ballineen School Line and a point 293 metres west of its junction with Bridge Street.

( b ) Bridge Street for a distance of 96 metres from its junction with the Cork-Bantry road.

( c ) The Ballineen School Line for a distance of 110 metres from its junction with the Cork-Bantry road.

8. The following road at Ballindangan:—

The Kilfinnane-Kilworth road between a point 250 metres north-west of its junction with the Glanworth-Mitchelstown road and a point 750 metres north west of the said junction.

9. The following roads at Ballingeary:—

( a ) The Cork-Glengariff road between a point 256 metres north-east of its junction with the Renaniree Road and a point 100 metres south of the centre line of Inchinossig Bridge.

( b ) The Renaniree Road for a distance of 580 metres north of its junction with the Cork-Glengarriff road.

( c ) The Old Road.

10. The following roads at Ballinhassig:—

( a ) The Halfway-Carrigaline road between a point 295 metres west of its junction with the Tullig Road and a point 275 metres east of the said junction.

( b ) The Tullig Road for a distance of 105 metres from its junction with the Halfway-Carrigaline road.

( c ) The Ballymartle Road for a distance of 100 metres from its junction with the Halfway-Carrigaline road.

11. The following roads at Ballinspittle:—

( a ) The Kinsale-Garrettstown Road between a point 210 metres north-east of its junction with the Ballincurrig Road and a point 65 metres south-east of its junction with the road to the Church crossroads.

( b ) The Ballinadee Road for a distance of 220 metres north-west of its junction with the Kinsale-Garrettstown road.

( b ) a point on the Schull Road (National Road N71) 230 metres from its junction with Stabawl Hill.

( a ) The Mallow-Fermoy road (National Road N72) between a point 92 metres west of its junction with the Glanworth Road and a point 120 metres east of its junction with the Glenville Road.

( b ) The Glanworth Road for a distance of 200 metres from its junction with the Mallow-Fermoy road (National Road N72).

( c ) The Glenville Road for a distance of 120 metres from its junction with the Mallow-Fermoy road (National Road N72).

( a ) The Carrigaline-Ballinhassig road between a point 240 metres south-west of its junction with the Bowen's Cross Road and a point 250 metres north-east of the said junction.

The Macroom/Killarney (National Road N22) road between a point 250 metres south-east of its junction with the Reananarree Road and a point 60 metres west of its junction with the Mullaghanish Road.

21. The following roads at Ballynoe:—

( a ) The Conna-Killeagh road between a point 92 metres north of its junction with the Britway Road and a point 700 metres south of the said junction.

( b ) The Longueville Road for a distance of 145 metres from its junction with the Conna-Killeagh road.

( c ) The Britway Road for a distance of 92 metres from its junction with the Conna-Killeagh road.

22. The following roads in or adjacent to the town of Bandon:—

All roads adjacent to the town of Bandon which are in the area enclosed by a line commencing at a point on Lovell's Hill 530 metres north-west of the town boundary and drawn thence in straight lines successively to the following points—

( a ) a point on the Glasslinn Road (National Road N71) 1,520 metres east of its junction with Finbarr's Place,

( b ) a point on the Ballylangley Road 450 metres north-east of its junction with Old Quay Road,

( c ) a point on the Kilbrittan Road 80 metres south-east of its junction with Casement Road,

( d ) a point on the Cloncoolmore Road 515 metres south of its junction with the Clonakilty Road (National Road N71),

( a ) The Millstreet-Lombardstown road between a point 202 metres south-west of its junction with the Kanturk-Cork road and a point 458 metres north-east of the said junction.

( b ) The Kanturk-Cork road between a point 92 metres north-west of its junction with the Millstreet-Lombardstown road and a point 92 metres south-east of the said junction.

24. The following roads at Blarney:—

All roads in an area enclosed by a line commencing at a point on the Killowen Road 2000 metres north-west of its junction with the Blarney-Tower road and drawn thence in straight lines successively to the following points:—

( a ) a point on the Station Road 202 metres south of the centre line of Blarney Railway Bridge,

( b ) a point on the Cork-Blarney road 147 metres south-east of its junction with the Hedge Road,

( c ) a point on the Killard Road 1300 metres east of its junction with the Hedge Road,

( d ) a point on the Blarney-Tower road 50 metres north-east of its junction with the Bawnafinny Bridge Road,

and thence in a straight line to the commencement point on the Killowen Road.

25. The following roads at Boherboy or Boherbue:—

( a ) Captain Dan Vaughan Terrace, Clancy Terrace, Calvin Terrace, O'Connell Terrace.

( b ) The Mallow-Tralee road between a point 320 metres south-east of its junction with the Kanturk Road and a point 330 metres west of the said junction.

( c ) The Knocknagree Road for a distance of 521 metres from its junction with the Mallow-Tralee road.

( d ) The Kanturk Road between its junction with the Mallow-Tralee road and a point 675 metres south-west of Ballyhoolahan crossroads.

26. The following roads at Buttevant:—

( a ) Ball Alley Lane, Barrack Place, Military Road, New Street, St. Colman's Place, Mill Lane.

( b ) The Knockbarry Road for a distance of 942 metres from its junction with the Mallow-Limerick road (National Road N20).

( c ) The Liscarroll Road between its junction with the Mallow-Limerick road (National Road N20) and a point 340 metres west of its junction with the Military Road.

27. The following roads at Carrigaline:—

All roads in the area enclosed by a line commencing at a point on the Ringaskiddy Road 160 metres east of its junction with the Ballyhemiken Road, drawn thence to a point on the northern edge of the Crosshaven Road 1,200 metre east of its junction with the Minane Bridge Road, thence along the northern edge of the Crosshaven Road to a point 370 metres east of its junction with the Minane Bridge Road, thence in a straight line to a point on the southern edge of the Crosshaven Road opposite the last mentioned point and drawn thence in straight lines successively to the following points—

( a ) a point on the Dandy Bridge Road 600 metres east of its junction with the Minane Bridge Road,

( b ) a point on the Minane Bridge Road 550 metres south of its junction with the Dandy Bridge Road,

(a) The Kerry Pike-Matehy road between a point 540 metres north-west of its junction with the Bawnafinny Road and a point 1,210 metres north-west of its junction with the Cloghroe Road.

(a) The Midleton-Carlisle Fort road between a point 30 metres north of its junction with the Careystown Hill Road and a point 565 metres south-west of the said junction.

(c) The Careystown Hill Road for a distance of 600 metres from its junction with the Midleton-Carlisle Fort road.

(c) The Killeagh Road between a point 250 metres west of its junction with the Kilcoran Road and a point 570 metres west of its junction with the Claycastle Strand Road.

(d) The New Line Road for a distance of 183 metres from its junction with the Killeagh Road.

(e) The Bawnmore Road between its junction with the New Line Road and a point 18 metres south-west of its junction with Kilcoran Road.

(f) The Road connecting the Bawnmore Road with the Killeagh Road.

EXPLANATORY NOTE.

These Regulations replace the Road Traffic (Speed Limits) (County Borough of Cork and County of Cork) Regulations, 1986 ( S.I. No. 457 of 1986 ), and the Road Traffic (Speed Limits) (County Borough of Cork and County of Cork) (Amendment) Regulations, 1992 ( S.I. No. 98 of 1992 ) and alter the speed limits applicable to certain roads in Cork City and County.

The Regulations exclude the public roads mentioned in the First Schedule from the scope of the built-up area speed limit prescribed by section 45 of the Road Traffic Act, 1961 and declare the roads mentioned in the Second Schedule, to be subject to that limit.

The Regulations prescribe a speed limit of 40 mph in respect of the public roads mentioned in the Third Schedule.

Ambulances, fire brigade vehicles and Garda Síochána vehicles while being used in the course of duty are exempt from the speed limits prescribed by the Regulations.
