URBAN RENEWAL ACT, 1986 (REMISSION OF RATES) (AMENDMENT) SCHEME, 1994.

The Minister for the Environment in exercise of the powers conferred on him by section 7 of the Urban Renewal Act, 1986 (No. 19 of 1986) hereby makes the following amending scheme:—

1. This amending scheme may be cited as the Urban Renewal Act, 1986 (Remission of Rates) (Amendment) Scheme, 1994.

2. Article 4 of the Urban Renewal Act, 1986 (Remission of Rates) Scheme, 1986 ( S.I. No. 276 of 1986 ) as amended by the Urban Renewal Act, 1986 (Remission of Rates) (Amendment) Scheme, 1989 ( S.I. No. 195 of 1989 ) and the Urban Renewal Act, 1986 (Remission of Rates) (Amendment) Scheme, 1991 ( S.I. No. 192 of 1991 ) is hereby amended by the substitution for "31st day of May, 1993" of

"( a ) 31st day of July, 1994 or,

( b ) where a certificate under section 42 (8) of the Finance Act, 1986 (No. 13 of 1986), as inserted in that Act by section 35 (1) (a) (ii) of the Finance Act, 1994 (No. 13 of 1994), was given by the relevant local authority, the 31st day of December, 1994 or,

( c ) where, such certificate having been given, in relation to the erection of the premises the relevant local authority is satisfied that the foundations are laid in their entirety on or before the 31st day of December, 1994 or, in relation to the enlargement or improvement of the premises the relevant local authority is satisfied that not less than 25 per cent of the total cost of the enlargement or improvement is incurred before the 31st day of December, 1994, the 31st day of July, 1996."

3. Article 4 of the Urban Renewal Act, 1986 (Remission of Rates) Scheme, 1988 ( S.I. No. 93 of 1988 ) as amended by the Urban Renewal Act, 1986 (Remission of Rates) (Amendment) Scheme, 1991 ( S.I. No. 192 of 1991 ) is hereby amended by the substitution for "31st day of May, 1993" of

"( a ) 31st day of July, 1994 or,

( b ) where a certificate under section 42 (8) of the Finance Act, 1986 (No. 13 of 1986), as inserted in that Act by section 35 (1) (a) (ii) of the Finance Act, 1994 (No. 13 of 1994), was given by the relevant local authority, the 31st day of December, 1994 or,

( c ) where, such certificate having been given, in relation to the erection of the premises the relevant local authority is satisfied that the foundations are laid in their entirety on or before the 31st day of December, 1994 or, in relation to the enlargement or improvement of the premises the relevant local authority is satisfied that not less than 25 per cent of the total cost of the enlargement or improvement is incurred before the 31st day of December, 1994, the 31st day of July, 1996."

4. Article 4 of the Urban Renewal Act, 1986 (Remission of Rates) (No. 2) Scheme, 1988 ( S.I. No. 311 of 1988 ) as amended by the Urban Renewal Act, 1986 (Remission of Rates) (Amendment) Scheme, 1991 ( S.I. No. 192 of 1991 ) is hereby amended by the substitution for "31st day of May, 1993" of

"( a ) 31st day of July, 1994 or,

( b ) where a certificate under section 42 (8) of the Finance Act, 1986 (No. 13 of 1986), as inserted in that Act by section 35 (1) (a) (ii) of the Finance Act, 1994 (No. 13 of 1994), was given by the relevant local authority, the 31st day of December, 1994 or,

( c ) where, such certificate having been given, in relation to the erection of the premises the relevant local authority is satisfied that the foundations are laid in their entirety on or before the 31st day of December, 1994 or, in relation to the enlargement or improvement of the premises the relevant local authority is satisfied that not less than 25 per cent of the total cost of the enlargement or improvement is incurred before the 31st day of December, 1994, the 31st day of July, 1996."

5. Article 4 of the Urban Renewal Act, 1986 (Remission of Rates) Scheme, 1990 ( S.I. No. 205 of 1990 ) is hereby amended by the substitution for "31st day of May, 1993" of

"( a ) 31st day of July, 1994 or,

( b ) where a certificate under section 42 (8) of the Finance Act, 1986 (No. 13 of 1986), as inserted in that Act by section 35 (1) (a) (ii) of the Finance Act, 1994 (No. 13 of 1994), was given by the relevant local authority, the 31st day of December, 1994 or,

( c ) where, such certificate having been given, in relation to the erection of the premises the relevant local authority is satisfied that the foundations are laid in their entirety on or before the 31st day of December, 1994 or, in relation to the enlargement or improvement of the premises the relevant local authority is satisfied that not less than 25 per cent of the total cost of the enlargement or improvement is incurred before the 31st day of December, 1994, the 31st day of July, 1996."

6. Article 4 of the Urban Renewal Act, 1986 (Remission of Rates) (No. 2) Scheme, 1990 ( S.I. No. 288 of 1990 ) is hereby amended by the substitution for "31st day of May, 1993" of

"( a ) 31st day of July, 1994 or,

( b ) where a certificate under section 42 (8) of the Finance Act, 1986 (No. 13 of 1986), as inserted in that Act by section 35 (1) (a) (ii) of the Finance Act, 1994 (No. 13 of 1994), was given by the relevant local authority, the 31st day of December, 1994 or,

( c ) where, such certificate having been given, in relation to the erection of the premises the relevant local authority is satisfied that the foundations are laid in their entirety on or before the 31st day of December, 1994 or, in relation to the enlargement or improvement of the premises the relevant local authority is satisfied that not less than 25 per cent of the total cost of the enlargement or improvement is incurred before the 31st day of December, 1994, the 31st day of July, 1996."

7. Article 4 of the Urban Renewal Act, 1986 (Remission of Rates) Scheme, 1992 ( S.I. No. 343 of 1992 ) is hereby amended by the substitution for "31st day of May, 1994 and the foundations for which were laid in their entirety on or before the 31st of May, 1993" of

"( a ) 31st day of July, 1994 or,

( b ) where a certificate under section 42 (8) of the Finance Act, 1986 (No. 13 of 1986), as inserted in that Act by section 35 (1) (a) (ii) of the Finance Act, 1994 (No. 13 of 1994), was given by the relevant local authority, the 31st day of December, 1994 or,

( c ) where, such certificate having been given, in relation to the erection of the premises the relevant local authority is satisfied that the foundations are laid in their entirety on or before the 31st day of December, 1994 or, in relation to the enlargement or improvement of the premises the relevant local authority is satisfied that not less than 25 per cent of the total cost of the enlargement or improvement is incurred before the 31st day of December, 1994, the 31st day of July, 1996."

8. Article 4 of the Urban Renewal Act, 1986 (Remission of Rates) Scheme, 1993 ( S.I. No. 229 of 1993 ) is hereby amended by the substitution for "31st day of July, 1994" and the foundations for which were laid in their entirety on or before the 30th day of November, 1993" of

"( a ) 31st day of July, 1994 or,

( b ) where a certificate under section 42 (8) of the Finance Act, 1986 (No. 13 of 1986), as inserted in that Act by section 35 (1) (a) (ii) of the Finance Act, 1994 (No. 13 of 1994), was given by the Right Honourable the Lord Mayor, Aldermen and Burgesses of Dublin, the 31st day of December, 1994 or,

( c ) where, such certificate having been given, in relation to the erection of the premises the Lord Mayor, Aldermen and Burgesses of Dublin are satisfied that the foundations are laid in their entirety on or before the 31st day of December, 1994 or, in relation to the enlargement or improvement of the premises the Lord Mayor, Aldermen and Burgesses of Dublin are satisfied that not less than 25 per cent of the total cost of the enlargement or improvement is incurred before the 31st day of December, 1994, the 31st day of July, 1996."

EXPLANATORY NOTE.

This scheme extends the qualifying period within which certain works must be carried out in certain designated areas in order to be eligible for remission of rates under the Urban Renewal Act, 1986 . The revised closing date is 31st July, 1994. In certain cases the closing date may be extended to 31 December, 1994 or 31 July, 1996.
