S.I. No. 203/1994 - Food Standards (Fruit Juices and Fruit Nectars) (European Communities) (Amendment) Regulations, 1994.


I, JOE WALSH, Minister for Agriculture, Food and Forestry in exercise of the powers conferred on me by section 2 of the Food Standards Act, 1974 (No.11 of 1974 ), and the Food Standards (Transfer of Departmental Administration and Ministerial Functions) Order, 1987, for the purpose of giving effect to Commission Directive 93/45/EEC of 17 June, 1993(1) and having consulted the Minister for Enterprise and Employment and the Minister for Health and such organisations as appear to me to be interested to a substantial extent in the subject matter, hereby make the following Regulations.

1. These Regulations may be cited as the Food Standards (Fruit Juices and Fruit Nectars) (European Communities) (Amendment) Regulations, 1994.

2. The Principal Regulations, the Food Standards (Fruit Juices and Fruit Nectars) (European Communities) (Amendment) Regulations, 1984 ( S.I. No. 266 of 1984 ), the Food Standards (Fruit Juices and Fruit Nectars) (European Communities) (Amendment) Regulations, 1992 ( S.I. No. 27 of 1992 ), and these Regulations may be cited together as the Food Standards (Fruit Juices and Fruit Nectars) (European Communities) Regulations, 1978 to 1994, and shall be construed together as one.

3. In these Regulations "the Principal Regulations" means the Food Standards (Fruit Juices and Fruit Nectars) (European Communities) Regulations, 1978 ( S.I. No. 173 of 1978 ).

4. Reference in the Principal Regulations to Council Directive 75/726/EEC of 17 November, 1975(2) shall be construed as references to that Directive as amended by Council Directive 79/168/EEC of 5 February 1979(3), Council Directive 81/487/EEC of 30 June, 1981(4), Council Directive 89/394/EEC of 14 June, 1989(5) and Commission Directive 93/45/EEC of 17 June, 1993(6).

5. The fruits set out in Points II and III of the Annex to Directive 75/726/EEC, and apricots, may be used, individually or mixed together, to manufacture nectars without the addition of sugars or honey where their naturally high sugar content so warrants.

EXPLANATORY NOTE.

These Regulations amend the Food Standards (Fruit Juices and Fruit Nectars) (European Communities) Regulations, 1978 to 1992, to give effect to Commission Directive 93/45/EEC which amends Council Directive 75/726/EEC on the approximation of the laws of the Member States concerning fruit juices and certain similar products.

The Regulations permit the manufacture of nectars, without the addition of sugars or honey, from certain fruits which have a high natural sugar content.

These Regulations should be read together with the Council and Commission Directives.
