CASTLETOWNBERE FISHERY HARBOUR CENTRE (RATES AND CHARGES) ORDER, 1985.

I, PADDY O'TOOLE, Minister for Fisheries and Forestry, in exercise of the powers conferred on me by section 4 of the Fishery Harbour Centres Act, 1968 (No. 18 of 1968), and the Fisheries (Transfer of Departmental Administration and Ministerial Functions) Order, 1977 ( S.I. No. 30 of 1977 ) (as adapted by the Ministers and Secretaries (Amendment) Act, 1983 (No. 40 of 1983), and by the Fisheries (Alteration of Name of Department and Title of Minister) Order, 1978 ( S.I. No. 195 of 1978 )), and after consultation with the Minister for Communications, hereby order as follows:

1. This Order may be cited as the Castletownbere Fishery Harbour Centre (Rates and Charges) Order, 1985.

2. This Order shall come into operation on the 18th day of March, 1985.

3. In this Order—

"fish" has the same meaning as in the Fisheries (Consolidation) Act, 1959 (No. 14 of 1959) as amended by the Fisheries (Amendment) Act, 1978 (No. 18 of 1978);

"length" in relation to a boat means the overall length of the boat.

4. Each rate or charge specified in column (3) of the Schedule to this Order at a particular reference number is hereby fixed as the rate or charge for the use in the fishery harbour centre known as Castletownbere Fishery Harbour Center of the facility or service described in column (2) of the Schedule at that reference number.

5. (1) A rate or charge fixed by this Order shall be paid to the Minister by the person using the facility or service concerned.

(2) An amount due under this Order may be recovered by the Minister either as a simple contract debt in a court of competent jurisdiction or by distress and sale of any ship, boat or goods in respect of which the amount is due.

6. The Castletownbere Fishery Harbour Centre (Rates and Charges) Order, 1979 ( S.I. No. 12 of 1979 ), is hereby revoked.

if boat is 75 feet or over but under 100 feet (30.48 metres) in length

(d)

if boat is 100 feet or over in length

£1.80 for each entry into harbour, or £45 for each year payable in advance on each October 1st.

Use of harbour in connection with cargo of fish—

fresh fish (including fish withdrawn under EEC regulations)

10p per 50 kgs.

fish for reduction to fishmeal

5p per 50 kgs.

90p each entry into harbour.

Use of electricity

90p per hour.

Use of harbour landing facilities or associated land areas for washing fish boxes

£3.60 per day.

Use of fresh water

72p per tonne.

Use of hose

36p per occasion.

Rope money

£13.50 per trip.

Use of berthage or moorings provided by harbour authority for purposes other than loading or discharging

6p on every tonne of (a) the net Register Tonnage or (b) fifty per cent of Gross Tonnage, whichever is greater. These charges are not applicable to passenger and general cargo ferry boats plying solely between Bere Island and Castletownbere.

Use of berthage or moorings provided by harbour authority for loading or discharging

18p on every tonne of (a) the net Register Tonnage or (b) fifty per cent of the Gross Tonnage, whichever is greater.

These charges are not applicable to passenger and general cargo ferry boats plying solely between Bere Island and Castletownbere.

Use of harbour by vessel laid up at pier, quay, berthage or jetty—

(a)

For the first two weeks the rate of charge at reference 9 above is applicable.

(b)

For every day after two weeks and up to the end of the fifth week, 12p per day per metre of length of boat.

(c)

For each additional day after five weeks 22p per metre of length of boat.

Use of harbour in connection with miscellaneous cargo—

(a)

cured or salted fish

4p per barrel.

(b)

salt

6p per tonne.

(c)

empties

3p each.

(d)

solid fuel

9p per tonne.

(e)

manure

18p per tonne.

(f)

large animals

15p each.

(g)

small animals (excluding cats and dogs)

7p each.

(h)

other cargo

36p per tonne.

These charges are not applicable to goods being carried from Castletownbere to Bere Island for use by the people of Bere Island, nor to empties being returned from the Island.
