LICENSING OF SEA-FISHING BOATS (EXEMPTION) REGULATIONS, 1983. | ||
I, PADDY O'TOOLE, Minister for Fisheries and Forestry, in exercise of the powers conferred on me by subsection (4) (b) of section 222 B (inserted by the Fisheries (Amendment) Act, 1983 (No. 27 of 1983)) of the Fisheries (Consolidation) Act, 1959 ) (No. 14 of 1959), and the Fisheries (Transfer of Departmental Administration and Ministerial Functions) Order, 1977 ( S.I. No. 30 of 1977 ) (as adapted by the Fisheries (Alteration of Name of Department and Title of Minister) Order, 1978 ( S.I. No. 195 of 1978 )), hereby make the following regulations:— 1. These Regulations may be cited as the Licensing of Sea-fishing Boats (Exemption) Regulations, 1983. 2. In these Regulations "length", in relation to a sea-fishing boat, means the distance from the forepart of the stem of the boat to— | ||
( a ) in case the boat has a sternpost, the aft side of the head of the sternpost, | ||
( b ) in any other case, the forepart of the rudder stock. 3. A sea-fishing boat which measures 65 feet or less in length shall be exempt from the provisions of subsection (2) of section 222 B (inserted by section 2 of the Fisheries (Amendment) Act, 1983 (No. 27 of 1983)) of the Fisheries (Consolidation) Act, 1959 (No. 14 of 1959). | ||

EXPLANATORY NOTE. | ||
The effect of these Regulations is to exempt Irish sea-fishing boats of 65 feet and under in the defined length from the provisions of subsection (2) of section 222 B of the Fisheries (Consolidation) Act, 1959 which requires that sea-fishing boats shall not fish except under licence by the Minister for Fisheries and Forestry. |
