WILDLIFE (WILD BIRDS) (OPEN SEASONS) (AMENDMENT) ORDER, 1980.

I, PATRICK POWER, Minister for Fisheries and Forestry, in exercise of the powers conferred on me by sections 8 and 24 of the Wildlife Act, 1976 (No. 39 of 1976), as adapted by the Fisheries (Alteration of Name of Department and Title of Minister) Order, 1978 ( S.I. No. 195 of 1978 ), do hereby order as follows:—

1. (1) This Order may be cited as the Wildlife (Wild Birds) (Open Seasons) (Amendment) Order, 1980.

(2) The Principal Order and this Order may be cited together as the Wildlife (Wild Birds) (Open Seasons) Orders, 1979 and 1980.

2. In this Order "the Principal Order" means the Wildlife (Wild Birds) (Open Seasons) Order, 1979 ( S.I. No. 192 of 1979 ).

3. The Principal Order is hereby amended by—

( a ) the substitution of the following for the entry in Part II of the First Schedule:

( b ) the substitution of "east" for "west" in clause (b) of paragraph 7(2) of Part I of the Second Schedule;

( c ) the insertion of "(which point and Bench Mark are both in the townland of Marble Hill)" after "Bench Mark 42.0" in paragraph 12 of the said Part I;

( d ) the substitution of the following for paragraph 51 of Part I of the Second Schedule:

"51. River Slaney (part) in the County of Wexford.

The lands in the County of Wexford (together with the lands forming the islands therein), being lands which at high water are covered by the waters of the River Slaney, which are enclosed by a line drawn from the point on the townland boundary of Jamestown townland which is 304 yards distant from the point on the east bank of the said river where the said townland boundary meets the townland boundary of Redmondstown townland, then projected westwards in a straight line through the southernmost tip of the promontory in the said river, known locally as "The Ham", to the railway line on the western bank of the said river, then continuing northwards along the western edge of the railway line between Enniscorthy and Wexford to the point 187 yards distant from the townland boundary between the townlands of Mackmine and Kilgibbon townlands, then continuing east along the northern edge of the drain at the last-mentioned point to where it meets the townland boundary of Mackmine townland (a point 260 yards south of the north-eastern tip of Mackmine townland), then projected due east across the said river to the point where it meets the townland boundary of Tincoon townland (a point 647 yards south of the north-west corner of Tincoon townland), then finally continuing, initially southwards, along the townland boundary between Tincoon and Jamestown townlands to the point first mentioned."; and

( e ) the addition to Part I of the Second Schedule of the following paragraphs:

"58. River Blackwater (part) in the County of Waterford.

The waters, islands and weirs of the River Blackwater in the County of Waterford which lie between Ballyduff Bridge and Lismore Bridge, together with the lands which are enclosed by a line drawn from the southern end of the downstream parapet of Ballyduff Bridge east along the southern bank of the said river for 792 yards to the point where it meets a fence, then continuing along that fence in a south-easterly direction for 33 yards to the point where it meets a ditch, then continuing along the said ditch in an easterly direction through the townlands of Ballyduff Lower, Glen Beg, Ballygally West, Ballygally, and Ballygally East to the bank of the said river in Ballygally East townland, then continuing east along the said southern bank for 792 yards to the point where it meets a fence, then continuing, initially in a south-easterly direction, along the last-mentioned fence for 418 yards, then for a distance of 814 yards in a north-easterly direction, and then in an easterly direction to the point where the said last-mentioned fence meets the townland boundary between Glencairn and Fort William townlands, then continuing along the said townland boundary in a southerly direction for 132 yards to the point where it meets a fence, then continuing in an easterly direction, initially along the last-mentioned fence and then along a drain to where it meets the sluice (in the townland of Castlelands) on the said southern bank, opposite Cottage Island; then continuing eastwards along the said southern bank to the upstream parapet of Lismore Bridge, then continuing along the last-mentioned parapet and then westwards along the country road between Lismore and Ballyduff to the point where it meets the townland boundary between the townlands of Ballyduff and Garrison, then finally continuing in a southerly direction along the last-mentioned townland boundary and the downstream parapet of Ballyduff Bridge to its southern end.

59. River Barrow (part) in the County of Carlow.

The waters, islands, weirs, and lands in the County of Carlow enclosed by a line drawn from the south-eastern end of the upstream parapet of Royaloak Bridge, initially north-eastwards along the southern edge of the drain lying south of the towpath to the draw-bridge, then continuing through the town of Muine Bheag along the Quay and Brewery Road, then continuing along the county road to Leighlinbridge to the point where it meets the boundary of the said town, then continuing south-westwards along the said town boundary, across the River Barrow, to the western bank of the said river, then continuing downstream, along the western bank of the said river to the point on the said western bank 67 yards north-east of the north-western end of the said parapet, at which point it meets a fence, then continuing along the said fence to the said upstream parapet, and then finally continuing along the said parapet to its southern end.";

and the said clause (b) and the said paragraph 12, as amended by this Article, are set out in paragraphs 1 and 2, respectively, of the Table to this Article.

TABLE

1. ( b ) the part of the townland of Ballynamona which lies east of the said public road and is enclosed by an imaginary line drawn from spot level 31.00 on the said public road along the northern side of the road which runs eastwards at that spot level, initially eastwards for 155 yards, then continuing initially south south-eastwards along the said road for 725 yards, to the fence at that point, then continuing northwards, along the said fence for 235 yards to the townland boundary between the townlands of Shannagarry South and Ballynamona, then continuing eastwards along the said townland boundary for 400 yards to the shingle bank, then continuing southwards along the western side of that shingle bank for 330 yards, then continuing, initially southwards, along the High Water Mark for 1,400 yards to the fence at that point and then continuing along that fence in a south-westerly direction for 210 yards to the townland boundary between the townlands of Monagurra and Ballynamona, and then continuing along that townland boundary to where it meets the public road, and finally continuing along the public road to the said spot level 31.00.

2.12. Ards in the County of Donegal.

The area in the County of Donegal enclosed by an imaginary line drawn along the public road from Clon Bridge, Creeslough, to the point on that road which is 40 yards south of Bench Mark 42.0 (which point and Bench mark are both in the townland of Marble Hill) and then continuing along the High Water Mark, initially in a south-easterly direction, to the most north-easterly point of Clonmass Isle, and then continuing from that point in a straight line to Binnagorm Point, and then continuing along the High Water Mark, initially in a south-westerly direction, to the point where an imaginary line projected due north from Rinnarispy Point, having crossed the (sea) channel, meets the High Water Mark, and then continuing to Rinnarispy Point along that imaginary line so projected, and then continuing along the High Water Mark and the boundary of the townland of Masiness, initially in a south-westerly direction, to the said Clon Bridge.

EXPLANATORY NOTE.

The effect of the Order is to shorten the open season in respect of the Greenland White-fronted Goose, and to amend existing and include new areas, excluded from the effects of open seasons.
