WILDLIFE ACT, 1976 (CERTIFICATE OF PEACE COMMISSIONER) REGULATIONS, 1977.

I, PATRICK S. DONEGAN, Minister for Fisheries, in exercise of the power conferred on me by section 78 (7) of the Wildlife Act, 1976 (No. 39 of 1976) (as adapted by the Lands (Alteration of Name of Department and Title of Minister) Order, 1977 ( S.I. No. 29 of 1977 )), hereby make the following regulations:—

1. These Regulations may be cited as the Wildlife Act, 1976 (Certificate of Peace Commissioner) Regulations, 1977.

2. A certificate for the purposes of section 78 (7) of the Wildlife Act, 1976 shall be in the form set out in the Schedule to these Regulations.

EXPLANATORY NOTE.

The purpose of these Regulations is to prescribe the form of certificate which a Peace Commissioner shall give to a member of the Garda S¡ochána or an authorised person under the Wildlife Act, 1976 , who applies to him for a direction to dispose of things seized under the Act before they can be used as evidence in proceedings for an offence under the Act. In any such proceedings the certificate shall, in accordance with Section 78 (7) of the Act, be accepted as sufficient evidence of the facts stated in it until the contrary is shown by the defendant.
