AIR NAVIGATION (FEES) ORDER, 1976.

I, PETER BARRY, Minister for Transport and Power, in exercise of the powers conferred on me by sections 5 , 9 and 11 of the Air Navigation and Transport Act, 1946 (No. 23 of 1946), and the Transport, Fuel and Power (Transfer of Departmental Administration and Ministerial Functions) Order, 1959 ( S.I. No. 125 of 1959 ), hereby order as follows:

1. (1) This Order may be cited as the Air Navigation (Fees) Order, 1976.

(2) This Order shall come into operation on the 25th day of March, 1976.

2. In this Order "the Minister" means the Minister for Transport and Power.

3. The Air Navigation (Fees) Order, 1963 ( S.I. No. 65 of 1963 ), is hereby revoked.

4. There shall be charged and levied for the issue of a certificate of registration of an aircraft fees in accordance with the following scale:—

where the maximum total authorised weight of the aircraft—

£

(a) does not exceed 2,730 kgs.

(b) exceeds 2,730 kgs. but does not exceed 5,700 kgs.

(c) exceeds 5,700 kgs. but does not exceed 13,600 kgs.

20.00

(d) exceeds 13,600 kgs. but does not exceed 45,500 kgs.

(e) exceeds 45,500 kgs.

5. There shall be charged and levied for the issue of a certificate of type approval a fee of an amount equivalent to the cost of such investigations as were required by the Minister for the purpose of issuing the certificate.

6. (1) There shall be charged and levied for the issue of a certificate of airworthiness or a certificate of airworthiness for export a fee of an amount equivalent to the cost of such investigations as were required by the Minister for the purpose of issuing the certificate of airworthiness or the certificate of airworthiness for export.

(2) In the case of an aircraft in respect of which a certificate of airworthiness or a certificate of airworthiness for export has previously been issued, there shall be charged and levied for the issue or validation of a certificate of airworthiness or a certificate of airworthiness for export a fee in accordance with the following scale:

(a) in the case of a glider of which the maximum total authorised weight does not exceed 910 kgs.

(b) in the case of a glider of which the maximum total authorised weight exceeds 910 kgs.

(c) in the case of any other aircraft for every 455 kgs. or part thereof

(3) There shall be charged and levied for the renewal of a certificate of airworthiness and for the renewal of a validation of a certificate of airworthiness or certificate of airworthiness for export a fee in accordance with the following scale:

£

(a) in the case of a glider of which the maximum total authorised weight does not exceed 910 kgs.

(b) in the case of a glider of which the maximum total authorised weight exceeds 910 kgs.

(c) in the case of any other aircraft for every 455 kgs. or part thereof

7. There shall be charged and levied for the issue of a flight permit a fee of an amount equal to the cost of such investigations as were required by the Minister for the purpose of issuing the flight permit.

8. There shall be charged and levied for the approval of a modification to an aircraft a fee of an amount equal to the cost of such investigations as were required by the Minister for the purpose of granting the approval.

9. There shall be charged and levied for the approval of an engine a fee of an amount equal to the cost of such investigations as were required by the Minister for the purpose of granting the approval.

10. There shall be charged and levied—

( a ) for the inspection of an organisation for the purpose of the approval of the organisation, a fee of £80 per annum for each branch of the organisation separately inspected;

( b ) for the approval of an organisation for the manufacture of materials, a fee of £25 per annum;

( c ) for the inspection of premises for the purpose of the approval of the premises for the storage of accessories and component parts, a fee of £25 per annum.

11. There shall be charged for an inspection on the application of an owner of an aircraft, (not being an inspection made with a view to issuing or renewing or validating a certificate of airworthiness or a certificate of airworthiness for export) for the purpose of seeing that the aircraft is airworthy and complies with the requirements for the issue of a certificate of airworthiness, a fee equal in amount to the cost of such investigations as were made for the purpose of the inspection.

12. There shall be charged and levied—

( a ) for the issue of a licence for an aerodrome, a fee of £16.50;

( b ) for the renewal of a licence for an aerodrome, a fee of £10.00;

( c ) for the variation of a licence for an aerodrome, a fee of £5.00.

13. (1) ( a ) There shall be charged and levied in respect of personnel licences fees in accordance with the scale set out in the Schedule to this Order.

( b ) (i) Where a medical examination is conducted by a specially qualified medical officer (appointed by the Minister under the Air Navigation (Personnel Licensing) Order, 1966) for the purpose of the grant, validation or renewal of a licence to act as a flight crew member, the fees payable for such an examination shall be:

(a) In the case of the grant or validation of a licence

(ii) Where only a part or parts of a medical examination referred to in (i) above is conducted, the fee payable for each such part shall be:

(a) radiography examination

(d) auditory acuity test

(e) special medical examination

The cost of such examination.

(2) Where an applicant for a personnel licence is exempt from examination or test, the appropriate fee may be remitted or reduced as the Minister thinks fit.

(3) Where an application for a personnel licence is withdrawn by the applicant or refused by the Minister, the appropriate fees may be refunded but the Minister may retain such amount of the fee as appears to him to be reasonable in respect of any examination or test already conducted pursuant to the application.

(4) If an endorsement of a personnel licence is made at the time of the issue of the licence or if at any other time the endorsement is made as a result of the passing by the applicant of an examination or test conducted by the Minister, the appropriate fee may be remitted.

(5) In the case of a holder of a Flight Radiotelegraphy Operator's Licence (temporary) who qualifies for the grant of a Flight Radiotelegraphy Operator's Licence the Minister, if he thinks fit, may remit in full the fee otherwise payable for the last-mentioned licence.

(6) In the case of a holder of a Flight Radiotelephony Operator's Licence (Restricted) who qualifies for the grant of a Flight Radiotelephony Operator's Licence (General) the Minister, if he thinks fit, may remit in full the fee otherwise payable for the last-mentioned licence.

14. The Minister may remit or reduce, in any case in which he is satisfied that it is reasonable to do so, any fee referred to or mentioned in Articles 5 to 9 of this Order.

EXPLANATORY NOTE.

This Order revokes and re-enacts with modifications the Air Navigation (Fees) Order, 1963. The principal effects of the Order are to increase the fees payable for registration of aircraft, the grant and renewal of certificates of airworthiness and validation thereof, as well as for licences for flight crew personnel and maintenance engineers, and licences for aerodromes.

The Order also introduces fees for a medical examination on validation of a licence, for inspection of an aircraft, without issue of a certificate, to see if it is airworthy, for a separate Instrument Rating for private pilots, and for the Controlled Visual Flight Rules Flight Rating.
