AIR NAVIGATION (FEES) ORDER, 1963.

I, ERSKINE H. CHILDERS, Minister for Transport and Power, in exercise of the powers conferred on me by sections 5 , 9 and 11 of the Air Navigation and Transport Act, 1946 (No. 23 of 1946), and the Transport, Fuel and Power (Transfer of Departmental Administration and Ministerial Functions) Order, 1959 ( S.I. No. 125 of 1959 ), hereby order as follows :

1. This Order may be cited as the Air Navigation (Fees) Order, 1963.

2. In this Order " the Minister " means the Minister for Transport and Power.

3. The following are hereby revoked :—

(i) Regulation 87 and Schedule II (inserted by paragraph 4 of the Air Navigation (Amendment) Order, 1951 ( S.I. No. 31 of 1951 )) of the Air Navigation (General) Regulations, 1930 ( S. R. & O. No. 26 of 1930 ) ; and

(ii) the Air Navigation (Personnel Licensing) (Fees) Order, 1951 ( S.I. No. 65 of 1951 ).

4. There shall be charged and levied for the issue of a certificate of registration of an aircraft a fee in accordance with the following scale :—

where the maximum total authorised weight of the aircraft—

5.—(1) There shall be charged and levied for each inspection of the aircraft register a fee of one shilling.

(2) There shall be charged and levied for each supply of entries from the aircraft register a fee of ten shillings.

6. There shall be charged and levied for the issue of a certificate of type approval a fee of an amount equivalent to the cost of such investigations as were required by the Minister for the purpose of issuing the certificate.

7.—(1) There shall be charged and levied for the issue of a certificate of airworthiness or a certificate of airworthiness for export a fee of an amount equivalent to the cost of such investigations as were required by the Minister for the purpose of issuing the certificate of airworthiness or the certificate of airworthiness for export.

(2) In the case of an aircraft in respect of which a certificate of airworthiness or certificate of airworthiness for export has previously been issued there shall be charged and levied for the issue or validation of a certificate of airworthiness or certificate of airworthiness for export a fee in accordance with the following scale :

8. There shall be charged and levied for the renewal of a certificate of airworthiness and for the renewal of a validation of a certificate of airworthiness or certificate of airworthiness for export, a fee in accordance with the following scale :

9. There shall be charged and levied for the issue of a flight permit a fee of an amount equal to the cost of such investigation as was required by the Minister for the purpose of issuing the flight permit.

10. There shall be charged and levied for the approval of a modification to an aircraft a fee of an amount equal to the cost of such investigations as were required by the Minister for the purpose of granting the approval.

11. There shall be charged and levied for the approval of an engine a fee in accordance with the following scale :

(a) where the power output of the engine as determined by the Minister :—

12. There shall be charged and levied—

(a) for the inspection of an organisation for the purposes of the approval of the organisation a fee of £25 per annum. for each branch of the organisation separately inspected.

(b) for the inspection of a premises for the purposes of the approval of the premises for the storage of aircraft accessories and component parts a fee of £25 per annum.

13. There shall be charged and levied—

(a) for the issue of a licence for an aerodrome a fee of £5 0s. 0d.

(b) for the renewal of a licence for an aerodrome a fee of £3 0s. 0d., and

(c) for the variation of a licence for an aerodrome a fee of £2 0s. 0d.

14.—(1) There shall be charged and levied in respect of personnel licences fees in accordance with the scale set out in the Schedule to this Order.

(2) Where an applicant for a personnel licence is exempt from examination or test the appropriate fee may be either remitted or reduced as the Minister thinks fit.

(3) Where an application for a personnel licence is withdrawn by the applicant or refused by the Minister, the appropriate fees may be refunded but the Minister may retain such amount of the fee as appears to him to be reasonable in respect of any examination or test already conducted pursuant to the application.

(4) If an endorsement of a personnel licence is made at the time of the issue of the licence or at any other time as a result of the passing by the applicant of an examination or test conducted by the Minister for the purpose of making the endorsement, the appropriate fee may be remitted.

(5) In the case of a holder of a Flight Radiotelegraphy Operator's Licence (Temporary) who qualifies for the grant of a Flight Radiotelegraphy Operator's licence the Minister, if he thinks fit may remit in full the fee otherwise payable for such a licence.

(6) In the case of a holder of a Flight Radiotelephony Operator's Licence (Temporary) who qualifies for the grant of a Flight Radiotelephony Operator's Licence (General) the Minister, if he thinks fit, may remit in full the fee otherwise payable for such a licence.

15. The Minister may remit or reduce, in any case in which he is satisfied that it is reasonable to do so, any fee referred to or mentioned in paragraphs 6, 7, 8, 9, 10, or 11 of this Order.

EXPLANATORY NOTE.

This Order revokes and re-enacts with modifications the Air Navigation (Personnel Licensing) (Fees) Order, 1951 and Regulation 87 and Schedule II (inserted by paragraph 4 of the Air Navigation (Amendment) Order, 1951) of the Air Navigation (General) Regulations, 1930, which prescribed the fees to be paid in connection with certificates, licences and other documents, and with examinations, tests, inspections, investigations, permissions and approvals required by or for the purposes of the Air Navigation (General) Regulations, 1930 and the Air Navigation (Personnel Licensing) Order, 1951 as amended.

The principal effects of the Order are to increase the fees payable for registration of aircraft, the grant and renewal of certificates of airworthiness and validations thereof as well as for licences for professional aircraft pilots and for maintenance engineers whose licences relate to aircraft exceeding 12,500 lbs. in weight.

The Order also introduces fees for the grant and validation of certificates of airworthiness for export, the grant of flight permits and for the approval of modifications to aircraft, of engines and of organisations and premises.
