AIR NAVIGATION (PERSONNEL LICENSING) (FEES) ORDER, 1951.

I, T. F. O'HIGGINS, Minister for Industry and Commerce, in exercise of the powers conferred on me by the joint operation of section 9 and paragraph (j) of section 11 of the Air Navigation and Transport Act, 1946 (No. 23 of 1946), hereby order as follows :—

1. This Order may be cited as the Air Navigation (Personnel Licensing) (Fees) Order, 1951.

2. (1) Subject to paragraphs (2) and (3) of this Article, this Order shall come into operation on the 1st day of July, 1951.

(2) This Order shall be deemed to come into operation as to paragraph 11 of the Schedule hereto on the 1st day of April, 1951.

(3) Schedule II of the Air Navigation (General Regulations, 1930 ( S. R. & O. No. 26 of 1930 )), as amended, is hereby further amended by the deletion of paragraph D but notwithstanding such amendment and paragraph (1) of this Article, fees under subparagraph (b) of the said paragraph D shall, during the period ending on the 31st day of December, 1951, and no longer, continue to be payable in lieu of any equivalent fees under this Order.

3. In this Order—

" Flying test " includes any number of separate tests which may be prescribed under the Principal Order and which together comprise a test of skill ;

" Minister " means the Minister for Industry and Commerce ;

" technical examination " includes any number of separate subjects of examination and any oral examination or practical test associated with an examination required under the Principal Order ;

" type " means aircraft or engines which, in the opinion of the Minister, are of the same basic design, including all modifications thereto, except those modifications which in the opinion of the Minister result in a material change in flight or operating characteristics or maintenance requirements ;

" Principal Order " means the Air Navigation (Personnel Licensing) Order, 1951 ( S.I. No. 33 of 1951 ).

4. (1) Each fee mentioned in column (2) of the Schedule hereto shall be paid, in accordance with the provisions of this Order, in respect of the matter set out in column (1) of the said Schedule opposite the mention of the fee in the said column (2).

(2) The payment of any such fee shall not render the Minister liable to provide any aircraft and the provision of aircraft (if necessary) shall be the responsibility of the person paying such fee.

5. The fees mentioned in column (2) of the Schedule hereto shall be paid—

(a) for a technical or medical examination—before the examination ;

(b) for a flying test—before the test ;

(c) for a rating or a validation—before the rating is endorsed on the licence or before the validation is granted, as the case may be ;

(d) for the grant or renewal of a licence—before the licence is granted or renewed, as the case may be.

6. The Minister may remit or reduce (as the case may be) the fees mentioned in the Schedule hereto as follows and in the following circumstances :—

(a) if an applicant is exempted under paragraph (1) of Article 22 of the Principal Order from all examinations and tests, the appropriate fees may be remitted ;

(b) if an applicant is exempted under the said paragraph (1) from part of an examination or test, the appropriate fees may be reduced by such amount as the Minister may consider reasonable ;

(c) if an applicant is required to undergo a part only of any examination or test by reason of his having passed, within any period that the Minister may have specified, the remaining parts of the examination or test, the appropriate fees may be reduced by such amount as appears to the Minister to be a reasonable proportion in respect of the parts already passed ;

(d) if an applicant is exempted from any examination or test or any part of any examination or test by reason of his having already passed the same in connection with an application for another licence or rating, the appropriate fees may be remitted or may be reduced by such amount as appears to the Minister to be a reasonable proportion in respect of the parts already passed ;

(e) if an endorsement of a licence is made at the time of the grant of the licence or if it is made at any other time as a result of the passing by the applicant of an examination or test conducted by the Minister for the purpose of making the endorsement, the appropriate fee may be remitted ;

(f) if an applicant makes application for a licence and he has already undergone a medical examination (herein referred to as the former examination), for the grant or renewal of a licence, for which the medical requirements are not lower than for the medical examination (herein referred to as the later examination) for the grant of the licence to which the said application relates, the fees in respect of the later examination may be remitted provided that the former examination was passed within the period of duration specified in Article 13 of the Principal Order for a licence to which the said application relates ;

(g) if a licence is issued in exchange for a licence continued in force by paragraph (1) of Article 9 or paragraph (3) of Article 12 of the Principal Order, the appropriate fee may be remitted ;

(h) if an applicant withdraws his application or it is refused by the Minister, the appropriate fees may be refunded but the Minister may retain such amount of the fee as appears to him to be a reasonable proportion in respect of any examination or test already conducted pursuant to the application.

An additional type rating will be required if the type of engines specified in a rating is replaced by a different type.
