TELEPHONE (AMENDMENT) REGULATIONS, 1971

I, GERARD COLLINS, Minister for Posts and Telegraphs, in exercise of the powers conferred on me by section 2 of the Telegraph Act, 1885, hereby make, with the consent of the Minister for Finance, the following regulations:

1. (1) These Regulations may be cited as the Telephone (Amendment) Regulations, 1971.

(2) The Telephone Regulations, 1959 to 1970, and these Regulations may be cited together as the Telephone Regulations, 1959 to 1971.

2. These Regulations shall come into operation on the 15th day of February, 1971.

3. The Interpretation Act, 1937 (No. 38 of 1937), applies to these Regulations.

4. In these Regulations—

"the Regulations of 1964" means the Telephone (Amendment) Regulations, 1964 ( S.I. No. 153 of 1964 );

"the Regulations of 1968" means the Telephone (Amendment) Regulations, 1968 ( S.I. No. 274 of 1968 );

"the Regulations of 1969" means the Telephone (Amendment) Regulations, 1969 ( S.I. No. 185 of 1969 );

"the Regulations of 1970" means the Telephone (Amendment) Regulations, 1970 ( S.I. No. 213 of 1970 ).

5. The Telephone Regulations, 1959 ( S.I. No. 118 of 1959 ), shall be amended by:

(a) the substitution of "1.66p" for "fourpence" in Regulation 5 (2) (a), as amended by Regulation 5 of the Regulations of 1968;

(b) the substitution of "1.75p" for "fivepence" in Regulation 5 (2) (b), as amended by Regulation 4 (1) (a) of the Regulations of 1969;

(c) the substitution of "2p" for "sixpence" in Regulation 5 (3) (a), as amended by Regulation 4 (1) (b) of the Regulations of 1969;

(d) the substitution of "2p" for "sixpence" in Regulation 5 (3) (b), as amended by Regulation 4 '(1) (c) of the Regulations of 1969;

(e) the insertion of "who rents a coin box exchange line which is neither constructed nor adapted for decimal working" after "by a subscriber" in Regulation 6 (1);

(f) the insertion of "who rents a coin box exchange line which is neither constructed nor adapted for decimal working" after "by a subscriber" in Regulation 6 (1A) (inserted by Regulation 5 (b) of the Regulations of 1968);

(g) the insertion of "other than a coin box exchange line constructed or adapted for decimal working", after "coin box exchange line" in Regulation 6 (2);

(h) the substitution of "a coin box exchange line which is neither constructed nor adapted for decimal working there shall be placed in the coin box, in addition to the sum chargeable "for" a call office there shall be charged and paid and in respect of every trunk call (excluding subscriber dialled trunk calls) which is made from a coin box exchange line there shall be placed in the coin box, in addition to the sum chargeable or required to be placed in the coin box, as the case may be", in Regulation 6 (3);

(i) the insertion of the following after paragraph (3) of Regulation 6:

"(4) In respect of every trunk call (excluding subscriber dialled trunk calls) made at or after 8 a.m. and before 6 p.m. by a subscriber who rents an exchange line without a coin box there shall be charged to the subscriber and paid by him—

(a) where the distance between the group centres of the exchanges connected for the purpose of the call does not exceed thirty-five miles for each period of three minutes or part of three minutes during which the call continues the charge stated in the Fourth Schedule to these Regulations which is appropriate to the call, or

(b) where the distance between the group centres of the exchanges connected for the purpose of the call exceeds thirty five miles—

(i) if the duration of the call does not exceed three minutes, the charge stated in the Fourth Schedule to these Regulations which is appropriate to the call, or

(ii) if the duration of the call exceeds three minutes, the charge stated in the said Fourth Schedule which is appropriate to the call together with, for each minute or part of a minute in excess of three minutes during which the call continues, a further charge equal to one third of the said charge stated in the Fourth Schedule which is appropriate to the call.

(5) In respect of every trunk call (excluding subscriber dialled trunk calls) made at or after 6 p.m. and before 8 a.m. by a subscriber who rents an exchange line without a coinbox there shall be charged to the subscriber and paid by him—

(a) where the distance between the group centres of the exchanges connected for the purpose of the call does not exceed fifty miles for each period of three minutes or part of three minutes during which the call continues the charge stated in the Fourth Schedule to these Regulations which is appropriate to the call, or

(b) where the distance between the group centres of the exchanges connected for the purpose of the call exceeds fifty miles—

(i) if the duration of the call does not exceed three minutes, the charge stated in the Fourth Schedule to these Regulations which is appropriate to the call, or

(ii) if the duration of the call exceeds three minutes, the charge stated in the Fourth Schedule to these Regulations which is appropriate to the call together with, for each minute or part of a minute in excess of three minutes during which the call continues, a further charge equal to one third of the said charge stated in the said Fourth Schedule which is appropriate to the call.

(6) In respect of every trunk call (excluding subscriber dialled trunk calls) which is made from a coin box exchange line constructed or adapted for decimal working, there shall be charged to the subscriber and paid by him for each period of three minutes or part of three minutes during which the call continues the charge stated in the Fifth Schedule to these Regulations which is appropriate to the call, less the sum of ½p for each period of three minutes or part of three minutes during which the call continues.

(7) In respect of every trunk call (excluding subscriber dialled trunk calls) which is made by a caller from a call office or from a coin box exchange line which is constructed or adapted for decimal working—

(a) in case the call is made from a call office, there shall be charged and paid, and

(b) in case the call is made from a coin box exchange line, there shall be placed in the coin box

for each period of three minutes or part of three minutes during which the call continues the charge stated in the Fifth Schedule to these Regulations which is appropriate to the call."

(j) the substitution of "1.75p" for "twopence halfpenny" in Regulation 8 (3);

(k) the substitution of "10p" for "two shillings" in Regulation 9(1) (inserted by Regulation 5 (c) of the Regulations of 1968);

(l) the substitution of "1p" for "fourpence" in each place where it occurs in paragraphs (1) and (2) of Regulation 10;

(m) the substitution of the following for paragraph (3) of Regulation 10:

"(3) Where the sum chargeable and payable under paragraph (1) of 'this Regulation includes a fraction of a new penny, the said sum shall be rounded down to the nearest new penny and the resulting sum shall be chargeable and payable in respect of the call (in addition to such other charge or charges as may be payable under these Regulations in respect of the call).";

(n) the substitution in Regulation 12 of—

(i) "7p" and "6½p" for "one shilling and sixpence" and "one shilling and five pence halfpenny", respectively, in paragraph (a), and

(ii) "5p" for "one shilling" in paragraph (b);

(o) the substitution of "5p" for "one shilling" in Regulation 17A (inserted by Regulation 5 (e) of the Regulations of 1968);

(p) the substitution of "25p" for "five shillings" in Regulation 18 (3);

(q) the substitution of "37½p" for "7s 6d" in Regulation 44;

(r) the substitution of the following for the heading at the top of the Table in the First Schedule;

"Charges for Trunk Calls (other than Subscriber Dialled Trunk Calls) made from a Coin Box Exchange Line which is neither constructed nor adapted for decimal working";

(s) the substitution in the Second Schedule, as amended by Regulation 5 (g) of the Regulations of 1968, of–

(i) "1.66p" for "fourpence" in paragraph (a) and

(ii) "2p" for "three pence" in both places where it occurs in paragraphs (b) and (c);

(t) the substitution of the following for the Third Schedule (inserted by Regulation 4 (f) of the Regulations of 1964 and amended by Regulation 4 of the Regulations of 1970):

EXPLANATORY NOTE.

The purpose of these regulations is to amend the Telephone Regulations 1959 to 1970 to provide for the conversion of £sd charges to decimal charges and to replace the call charge structure for trunk calls made from call office telephones or a coin box exchange line by a new structure whereby the call office fee, formerly charged as an addition to the normal charge for such a call, is incorporated in the charge for the call and to make the charges for all such calls applicable to each period of three minutes or part of three minutes during which the calls continue.
