S.I. No. 41/1961 - Garda Síochána Pay and Allowances Order, 1961.


I, OSCAR TRAYNOR, Minister for Justice, in exercise of the powers conferred on me by section 12 of the Police Forces Amalgamation Act, 1925 (No. 7 of 1925), and section 1 of the Garda Síochána Act, 1958 (No. 14 of 1958), with the sanction of the Minister for Finance and after due compliance with subsection (2) of the said section 12, hereby order as follows :

1.—(1) This Order may be cited as the Garda Síochána Pay and Allowances Order, 1961.

(2) The Garda Síochána Allowances Orders, 1947 to 1958, and this Order so far as it relates to the revocation of provisions contained in those Orders may be cited together as the Garda Síochána Allowances Orders, 1947 to 1961.

2. The Interpretation Act, 1937 (No. 38 of 1937), applies to this Order.

3. The Garda Síochána Pay (No. 2) Order, 1958 ( S.I. No. 156 of 1958 ), shall, from the 21st day of December, 1960, have effect as if—

(i) the rates and scales contained in the Schedule to this Order were substituted for the rates and scales contained in Article 4,

(ii) the following paragraph were inserted after paragraph (c) of Article 12 :

" (d) in respect of each member of the Force for whom, or (in the case of a member who is married) for whose family, suitable official quarters are available, to deductions in respect of such quarters at the following rates :

In exceptional circumstances the sum deducted in respect of official quarters may be restored, in whole or in part, if the Minister, with the sanction (which may be general or particular) of the Minister for Finance, is satisfied that the circumstances so warrant."

4. The following provisions are hereby revoked with effect from the 21st day of December, 1960 :

(a) Paragraphs (1), (2) and (3) of Article 4 of the Garda Síochána Allowances (Consolidation) Order, 1947 ( S. R. & O. No. 167 of 1947 ), the words "in addition to the allowance payable under paragraph (1) of this Article " in paragraph (4) of that Article and the words " and his rent allowance, if any " in Article 6 of that Order,

(b) Article 4 of the Garda Síochána Allowances Order, 1950 ( S.I. No. 174 of 1950 ), and the second sentence in Article 5 of that Order,

(c) the Garda Síochána Allowances (No. 2) Order, 1951 ( S.I. No. 409 of 1951 ),

(d) Articles 4 and 5 of the Garda Síochána Allowances Order, 1955 ( S.I. No. 271 of 1955 ),

(e) the Garda Síochána Pay (No. 2) Order, 1959 ( S.I. No. 146 of 1959 ),

(f) the Garda Síochána Pay (No. 2) Order, 1960 ( S.I. No. 264 of 1960 ),

(g) paragraph (1) of Article 3 of the Garda Síochána Pay Order, 1960 ( S.I. No. 102 of 1960 ).

EXPLANATORY NOTE

This Order provides for new rates of pay for members of the Garda Síochána consequent on the abolition of Rent Allowance and the inclusion of an element in lieu thereof in Garda pay.
