LOCAL GOVERNMENT (DUBLIN AND DROGHEDA) ACT 1765

CHAP. XXII.

An Act for continuing and amending an Act, intitled, An Act for the better regulating the Parish Watches, and amending Highways in this Kingdom, and for preventing the Misapplication of Publick Money; and also for establishing a regular Watch in the City of Dublin, and to prevent Mischief which may happen by graving in the River Liffey; and also for regulating the Watch in the town of Drogheda.

WHEREAS the funds, appointed for the support and maintenance of a strong and regular watch in the city of Dublin and the liberties thereof are insufficient for that purpose; and by reason of the great concourse of people from all parts of this kingdom to this city a strong and well regulated watch is of great importance for the preservation of the persons and properties of the inhabitants of the said city, and very necessary to prevent as well the mischiefs which may happen from fires, as murders, burglaries, robberies, and other outrages and disorders: we therefore, your Majesty’s most dutiful and loyal subjects, the commons of Ireland in Parliament assembled, do most humbly beseech your Majesty, that it may be enacted, and be it enacted by the King’s most excellent Majesty by and with the advice and consent of the lords spiritual and temporal and commons in this present Parliament assembled, and by the authority of the same, That from and after the first day of May one thousand seven hundred and sixty six all and every the houses within the said city of Dublin and liberties thereof shall pay, and are hereby charged with, an additional sum not exceeding the sum of six pence, nor less than the sum of three pence, for every pound of the yearly value of every such house or houses, over and above the sum of sixpence for every pound of the yearly value of every such house or houses charged by an act passed in the tenth year of his Majesty King George the first, intitled, An act for continuing and amending an act, intitled, An act for the better regulating the parish watches, and amending the highways in this kingdom; and for preventing the misapplication of publick money; and also for establishing a regular watch in the city of Dublin, and to prevent mischiefs which may happen by graving ships on the river Liffey; which said act is revived and continued by an act passed in the first year of his present Majesty, intitled, An act for reviving, continuing, and amending several temporary statutes, and for other purposes therein mentioned; and that the said additional charge of sixpence and three pence for every pound of the yearly value of every such house or houses shall be applotted, levied, raised, and accounted for, agreeable to the regulations in the aforesaid act of the tenth of his Majesty King George the first, and shall be paid and applied to the several uses, for which the same is payable by virtue of the act aforesaid and this present act.

Supervisors or usual quorum of them to erect watch and round house contiguous, where none,

and appoint stands so as to correspond,

on default the lord mayor.

Supervisors to nominate inspectors, above 3; constable by office, sworn, exempt from other publick duties,

to visit watch-houses make returns to lord mayor and supervisors and subject to their orders,

salary not above 10l. each,

removed on neglect, and others appointed.

II. And be it further enacted by the authority aforesaid, That from and after the first day of May one thousand seven hundred and sixty six it shall and may be lawful for the supervisors or directors of the watch, or the usual quorum of them, in their respective parishes to erect or provide a commodious room with proper conveniencies, and a round house in every parish contiguous to the watch house of the said parish, where the same are not already erected or provided; and that it shall and may be lawful for the directors or supervisors, or the usual quorum of them, and they are hereby required, so to appoint the places and stands of the watchmen in their respective parishes, as that they may best hold correspondence with each other, and with the watchmen of the adjoining parishes; and in default of such appointment the lord mayor of the said city for the time being shall appoint and ascertain the said stands; and that it shall and may be lawful for the said supervisors or directors, or the usual quorum of them, and they are hereby further required, to nominate and appoint one or more inspectors, not exceeding three in number, in their respective parishes; which inspectors shall by virtue of their offices be constables, and be sworn as such into office, and shall be exempt from publick duties, such only excepted as the supervisors or directors shall direct; and such inspectors so appointed shall visit the watch houses in their respective parishes, and make returns signed by them respectively to the lord mayor of the said city, and to the directors or supervisors of the watch, of the condition of the watch at such times, and be subject to such orders and regulations, as the directors or the usual quorum in their respective parishes shall appoint; and that it shall be lawful for the directors or supervisors in their respective parishes to allow a salary not exceeding ten pounds per annum to every such inspector, and to remove such inspectors as shall appear to neglect their duty, and immediately appoint others in their places.

III. And be it further enacted by the authority aforesaid, That the watchmen in the night shall be under the inspection and controul of the said supervisors or directors, the inspectors and the constables of the respective parishes; which said constables in their turns are hereby required to set and place their watch at eight o’clock in the night exactly, and continue their watch till seven in the morning from the first day of November to the first day of February, and from the first day of February to the first day of May at nine o’clock, and to continue their watch till six in the morning, and from the first day of May to the first day of August at ten o’clock, and to continue their watch till five in the morning, and from the first day of August to the first day of November at nine o’clock, and to continue their watch till six in the morning, in every year.

Lord mayor and seneschals every 1st Nov. and May, except Sunday, review the watch, and dismiss those unfit.

IV. And be it further enacted by the authority aforesaid, That it shall and may be lawful for the lord mayor of the city of Dublin within the said city, and for the respective seneschals of the manors or liberties of Saint Sepulchres, Thomas Court, and Donore in their respective manors or liberties, and they are hereby required, on every first day of November, unless the same shall happen on a Sunday, and in such case on every second day of November, and on every first day of May unless the same shall happen on a Sunday, and in such case on every second day of May, and at other times as often as shall to them seem convenient or necessary, and inspect and publickly review the watch of the said city, and manors or liberties; and in case any shall appear unfit for service from age, infirmity, or other causes, they shall in their respective jurisdictions dismiss such persons from serving as watchmen.

V. And be it further enacted by the authority aforesaid, That from and after the first day of May one thousand seven hundred and sixty six no person or persons keeping publick inns, alehouses, or houses of entertainment, or papists, shall be qualified to act as supervisors or directors of the watch; and that no person shall act as deputy constable, who shall not, after he is chosen by the church wardens and parishioners or the major part of them, be recommended by the supervisors or directors, or the usual quorum, in their respective parishes to the lord mayor for the time being as a fit person to serve in the said office, and be approved by the said lord mayor.

VI. And be it further enacted by the authority aforesaid, That from and after the first day of May one thousand seven hundred and sixty six the church wardens of every parish in their respective parishes shall within three months after every Easter Tuesday enter into office, and collect and pay over the watch money of their respective parishes to the supervisors or directors of the watch; which money so paid over shall be applied to the uses in this and the aforesaid former act contained, and to no other use whatsoever; and that it shall and may be lawful for the church wardens and parishioners of every parish, or the major part thereof, in their respective parishes to make such provision for superannuated watchman or watchmen maimed in their service of watchmen, or therein otherwise rendered incapable of further service, who shall be recommended by the supervisors or directors of the watch, as shall be suitable to the state of the fund for supporting a regular watch, and the merit and circumstances of the watchmen so recommended.

Not for those dismissed for neglect, &c.

VII. Provided always, That no person whatsoever, who shall be dismissed from his office of watchman for neglect or any other offence, shall be intitled to any relief or provision out of the said fund.

VIII. And be it further enacted by the authority aforesaid, That the several bridges on the river Anna Liffey shall be watched and guarded by watchmen of the parishes next adjoining the said bridges; which watchmen shall be so many in number, and subject to such regulations, as the lord mayor for the time being shall appoint.

IX. And be it further enacted by the authority aforesaid, That if it shall be found, that any surplus shall arise from the money collected by virtue of this and the aforesaid act, over and above what shall be necessary for the supporting and maintaining a regular watch, and carrying into execution the purposes of this and the aforesaid act, such surplus money shall be disposed of for the use and benefit of the respective parish, where such surplus shall arise, by the church wardens and parishioners of such parish, or the major part thereof, in such manner as they by any act of vestry shall direct and appoint.

X. And whereas the parish watches in the county of the town of Drogheda, as settled by an act passed in the sixth year of the reign of his late Majesty King George the first, intitled, An act for the better regulating the parish watches, and amending the highways in this kingdom, and for preventing the misapplication of publick money, are found very oppressive to the inhabitants in the said county living without the gates and walls of the said town: be it enacted by the authority aforesaid, That from the last day of the several adjournments of next July sessions for said town and county the inhabitants within the walls of said town, and the owners and occupiers of the several yards, warehouses, and cellars in the said town, shall pay yearly for every house inhabited, and for every yard and every warehouse or cellar occupied, the sum of four pence for every pound of the yearly value of said house, warehouse, yard, or cellar, according to the rent such house, yard, warehouse, or cellar might reasonably set for to a solvent tenant; which shall be in lieu of all taxes or duties, heretofore payable or demandable for watching or watch money by or from the inhabitants within the said walls; the said sum of four pence to be raised, paid, and accounted for, as is directed as to the city of Dublin by an act of Parliament passed in this kingdom in the tenth year of the reign of his late Majesty King George the first, intitled, An act for continuing and amending an act, intitled, An act for the better regulating the parish watches, and amending the highways in this kingdom, and for preventing the misapplication of publick money, and also for establishing a regular watch in the city of Dublin, and to prevent mischiefs which may happen by graving ships in the river Liffey; the said yearly value of all such houses, yards, warehouses, and cellars, to be settled by the justices of the peace of the said county and town of Drogheda at every July sessions, or at some adjournment thereof, to be held in open court; which court of sessions shall have the same powers in every respect, that the lord mayor and the several vestries in the said city of Dublin have by virtue of the said act, and in every respect to regulate and appoint the management thereof.

XI. And be it further enacted by the authority aforesaid, That this act shall be in force from the first day of May one thousand seven hundred and sixty six.
