Kildare Markets Act 1458

KILDARE MARKETS ACT 1458

Grant of fairs and markets in the town of Kildare to the Earls of Kildare.

X. Also, at the request of the Commons, That whereas the Earls of Kildare, lords of the town of Kildare, and all other lords of the same town had heretofore from time whereof memory runs not, held a market in the said town of Kildare on the Saturday from week to week. And forasmuch as there is a market held in the Naas in the county of Kildare on Monday. The which market of Kildare, if it were held on the said Saturday, would be injurious to the market of Naas held on the Monday; and the said market of Naas held on the Monday would be injurious to the said market of Kildare held on the Saturday. Whereupon the premises considered, and also consideration had to the good and voluntary services, to our sovereign lord the King that now is, heretofore performed by Thomas fitz-Morice, now Earl of Kildare, in resistance to the malice of the Irish enemies of our said lord the King in this land of Ireland: It is ordained and agreed by [authority] of the said parliament that the said Earl and his heirs male, earls and lords of the said town of Kildare, shall in the said town of Kildare have their markets in the said town of Kildare, to be held on Thursday from week to week for ever. And also that the said Earl and his said heirs male may have [a] fair to be held in the said town of Kildare once a year, that is to say, to begin on the feast of saint Bride the virgin, and so to last [three] days next ensuing for ever. And that the said Earl and his said heirs males may have and receive such customs of all things brought for sale to the aforesaid market and fair as the mayors and bailiffs and citizens of Dublin have and receive of all things brought for sale to the said [city]. And that all manner of men and persons of whatever condition they be, shall have free ocming, staying and going at the said market and fair, [and that a court may be held there] for causes commenced in the said market and fair, saving to every man his action who will sue in the said town of Kildare. And that Holy Church and all other persons who ought to be free of custom in the said town of Kildare, be free. And this for a single fee of twenty shillings to be paid into the Hanaper of our lord the King, of Ireland, for the great seal of our lord the King there.
