S.I. No. 599/2019 - European Union (Energy Efficiency) (Amendment) Regulations 2019

I, RICHARD BRUTON, Minister for Communications, Climate Action and Environment, in exercise of the powers conferred on me by section 3 of the European Communities Act 1972 (No. 27 of 1972), and for the purpose of giving further effect to Directive 2012/27/EU of the European Parliament and of the Council of 25 October 20121 , hereby make the following regulations: | ||
1. These Regulations may be cited as the European Union (Energy Efficiency) (Amendment) Regulations 2019. | ||
2. In these Regulations “Principal Regulations” means the European Union (Energy Efficiency) Regulations 2014 ( S.I. No. 426 of 2014 ). | ||
3. The Principal Regulations are amended- | ||
(a) in Regulation 3, in paragraph (5) by the substitution of the following for “These Regulations do not apply”: | ||
“These Regulations, other than Part 3, do not apply”, | ||
(b) in Regulation 11, in paragraph (2), by the substitution of “establish and publish” for “publish”; | ||
(c) in Regulation 14 - | ||
(i) in paragraph (1) - | ||
(I) in subparagraph (a), by the substitution of “subject to subparagraph (aa) the first audit” for “the first audit”, and | ||
(II) by the insertion of the following subparagraph after subparagraph (a): | ||
“(aa) the first audit of such a company that, before the coming into operation of the European Union (Energy Efficiency) (Amendment) Regulations 2019 ( S.I. No. 599 of 2019 ) was not a company to which this Part applied but that, from that date, is a company to which this Part applies, shall take place before 30 June 2020;”, | ||
(ii) in paragraph (2), by the substitution of the following for “the minimum criteria set out in Annex VI”: | ||
“the minimum criteria established and published in accordance with Regulation 11(2)”, and | ||
(iii) in paragraph (3), by the substitution of the following for “the minimum criteria set out in Annex VI”: | ||
“the minimum criteria established and published in accordance with Regulation 11(2)”, and | ||
(iv) by the insertion of the following paragraph after paragraph (4): | ||
“(4A) Where a company which is required to carry out an audit pursuant to this Regulation completes the audit in accordance with this Regulation, it shall report the fact of its completion to the SEAI in accordance with the guidelines of the SEAI in that behalf.”. | ||
