SOCIAL WELFARE (CONSOLIDATED CLAIMS, PAYMENTS AND CONTROL) (AMENDMENT) (NO. 4) (JOBSEEKER’S TRANSITIONAL PAYMENT) REGULATIONS 2016

I, LEO VARADKAR, Minister for Social Protection, in exercise of the powers conferred on me by section 4 (adapted by the Social and Family Affairs (Alteration of Name of Department and Title of Minister) Order 2010 ( S.I. No. 186 of 2010 )) of, and Rule 1(5) of Part 2 of Schedule 3 to, the Social Welfare Consolidation Act 2005 (No. 26 of 2005), hereby make the following Regulations:

Citation and construction

1. (1) These Regulations may be cited as the Social Welfare (Consolidated Claims, Payments and Control) (Amendment) (No. 4) (Jobseeker’s Transitional Payment) Regulations 2016.

(2) These Regulations and the Social Welfare (Consolidated Claims, Payments and Control) Regulations 2007 to 2016 shall be construed together as one and may be cited together as the Social Welfare (Consolidated Claims, Payments and Control) Regulations 2007 to 2016.

Commencement

2. These Regulations come into operation on 5 January 2017.

Calculation of means

3. Article 145A(3)(d) (inserted by article 3 of the Social Welfare (Consolidated Claims, Payments and Control) (Amendment) (No. 8) (Jobseeker’s Allowance Transition) Regulations 2015 ( S.I. No. 597 of 2015 )) of the Social Welfare (Consolidated Claims, Payments and Control) Regulations 2007 ( S.I. No. 142 of 2007 ) is amended by the substitution of “€110” for “€90”.

EXPLANATORY NOTE

(This note is not part of the Instrument and does not purport to be a legal interpretation.)

These Regulations provide for an increase of €20 from €90 to €110 in the weekly earnings disregard in the case of recipients of the Jobseeker’s Transitional Payment in line with the increase provided for the One-Parent Family Payment in section 24 of the Social Welfare Act 2016 .

The increase in the weekly earnings disregard in the case of recipients of the Jobseeker’s Transitional Payment is effective from 5 January 2017.
