I, SIMON COVENEY, Minister for Agriculture, Fisheries and Food, in exercise of the powers conferred on me by section 3 of the European Communities Act 1972 (No. 27 of 1972), for the purpose of giving further effect to Council Directive 92/43/EEC of 21 May 19921 (as amended by Council Directive 97/62/EC of 27 October 19972 , Regulation (EC) No. 1882/2003 of the European Parliament and of the Council of 29 September 20033 and Council Directive 2006/105/EC of 20 November 20064 ) and Directive 2009/147/EC of the European Parliament and of the Council of 30 November 20095 , so far as those Directives relate to the impact of sea-fisheries on the marine environment, hereby make the following regulations: | ||
1. These Regulations may be cited as the European Communities (Control on Mussel Fishing) Regulations 2008 (Amendment) Regulations 2011. | ||
2. The European Communities (Control on Mussel Fishing) Regulations 2008 ( S.I. No. 347 of 2008 ) are amended by deleting, in the Schedule, paragraph (u) (inserted by the European Communities (Control on Mussel Fishing) (Amendment) (No. 2) Regulations 2010 ( S.I. No. 592 of 2010 )). | ||
3. The European Communities (Control on Mussel Fishing) Regulations (Amendment) (No. 2) Regulations 2010 ( S.I. No. 592 of 2010 ) are revoked. | ||

These Regulations are to provide for the removal of the prohibition on fishing for mussel seed within a defined area of Dingle Bay in connection with the Birds and Habitats Directives. | ||
