S.I. No. 592/2010 - European Communities (Control on Mussel Fishing) Regulations (Amendment) (No. 2) Regulations 2010.

Notice of the making of this Statutory Instrument was published in

“Iris Oifigiúil” of 14th December, 2010.

I, BRENDAN SMITH, Minister for Agriculture, Fisheries and Food, in exercise of the powers conferred on me by section 3 of the European Communities Act 1972 (No. 27 of 1972) for the purpose of giving further effect to Council Directive No. 92/43/EEC of 21 May 19921 (as amended by Council Directive No. 97/62/EC of 27 October 19972 , Regulation (EC) No. 1882/2003 of the European Parliament and of the Council of 29 September 20033 and Council Directive No. 2006/105/EC of 20 November 20064 and Directive 2009/147/EC of the European Parliament and of the Council of 30 November 20095 , so far as those Directives relate to the impact of sea-fisheries on the marine environment, hereby makes the following regulations:

1. These Regulations may be cited as the European Communities (Control on Mussel Fishing) Regulations (Amendment)(No. 2) Regulations 2010.

2. The European Communities (Control on Mussel Fishing) Regulations 2008 ( S.I. No. 347 of 2008 ) are amended by the insertion in the Schedule, after paragraph (t), of—

“(u) in Dingle Bay, east of an imaginary line drawn from Latitude 52 degrees 6 minutes 32 seconds North, Longitude 9 degrees 57 minutes 54 seconds West, through Latitude 52 degrees 6 minutes 30 seconds North, Longitude 10 degrees 1 seconds West, through Latitude 52 degrees 4 minutes 53 seconds North, Longitude 9 degrees 59 minutes 57 seconds West to Latitude 52 degrees 4 minutes 54 seconds north, Longitude 9 degrees 59 minutes 11 seconds West, and”

(3) The European Communities (Control on Mussel Fishing) Regulations 2008 (Amendment) Regulations 2010 ( S.I. No. 412 of 2010 ) are revoked.

EXPLANATORY NOTE

(This note is not part of the Instrument and does not purport to be a legal interpretation).

These Regulations provide for the inclusion of Dingle Bay (as defined in paragraph 2) in the Schedule to Statutory Instrument 347 of 2008.
