S.I. No. 678/2010 - Planning and Development Act 2000 (Strategic Development Zone) Order 2010.


Notice of the making of this Statutory Instrument was published in

“Iris Oifigiúil” of 4th January, 2011.

The Government pursuant to a proposal by the Minister for the Environment, Heritage and Local Government following consultation by that Minister with the Grangegorman Development Agency and Dublin City Council, being of the opinion that the development specified in Article 4 is of economic and social importance to the State, in exercise of the powers conferred on them by section 166 of the Planning and Development Act 2000 (No. 30 of 2000) (as adapted by the Environment and Local Government (Alteration of Name of Department and Title of Minister) Order 2003 ( S.I. No. 233 of 2003 )), hereby order as follows:

1. (1) This Order may be cited as the Planning and Development Act 2000 (Strategic Development Zone) Order 2010.

(2) This Order shall come into operation on 22 December 2010.

2. In this Order “Act of 2000” means the Planning and Development Act 2000 (No. 30 of 2000).

3. The development agency specified for the purposes of section 168 (amended by section 50 of the Planning and Development (Amendment) Act 2010 (No. 30 of 2010)) of the Act of 2000 is the Grangegorman Development Agency.

4. The area consisting of the lands identified within the inner margin of the red line and hatched in grey, on the map titled “Grangegorman SDZ Boundary” and set out in the Schedule is designated as a site for the establishment of a strategic development zone in accordance with Part IX of the Act of 2000 for the provision of schools and other educational facilities, community facilities, including hospitals and other healthcare facilities and services, facilities for the elderly and people with disabilities, childcare services, commercial activities (including leisure and retail facilities) and sports and recreational facilities.

5. The site designated in Article 4 has been designated for the establishment of a strategic development zone for the development specified in that Article for the following reasons:

(a) the potential and need for comprehensive planning and development of the site due to its scale and configuration;

(b) the efficient use of public investment in infrastructural facilities;

(c) the giving of effect to the policies contained in—

(i) the strategic plan prepared by the Grangegorman Development Agency in accordance with section 12 of the Grangegorman Development Agency Act 2005 (No. 21 of 2005), and

(ii) the development plan made by Dublin City Council in accordance with section 9 of the Act of 2000.
