FINANCIAL EMERGENCY MEASURES IN THE PUBLIC INTEREST (REDUCTION IN PAYMENTS TO STATE SOLICITORS) REGULATIONS 2009

Notice of the making of this Statutory Instrument was published in

“Iris Oifigiúil” of 5th May, 2009.

I, BRIAN LENIHAN, Minister For Finance, in exercise of the powers conferred on me by section 10 of the Financial Emergency Measures in the Public Interest Act 2009 (No. 5 of 2009), having complied with subsections (4) and (5) of that section and having complied with subsections (4) and (7) of section 9, hereby make the following regulations:

1. These Regulations may be cited as the Financial Emergency Measures in the Public Interest (Reduction of Payments to State Solicitors) Regulations 2009.

2. These Regulations shall apply to payments made to a State Solicitor in respect of services rendered to or on behalf of the State under an agreement entered into with the Director of Public Prosecutions.

3. The payments that shall be made to a State Solicitor in respect of the services referred to in Article 2 shall, in respect of services rendered from the date of the making of these Regulations, be reduced in accordance with the rates specified in the Table to this Article.

A reduction of 8 per cent in the remuneration rates applicable on the day before these Regulations were made and payable to a State Solicitor under his or her agreement for legal services, entered into with the Director of Public Prosecutions, under each heading in the Schedule to that agreement (terms of payment) other than under the headings "Expenses Element" and "Photocopying Expenses".
