STATISTICS (BUILDING AND CONSTRUCTION INQUIRIES) ORDER 2009

Notice of the making of this Statutory Instrument was published in

“Iris Oifigiúil” of 3rd April, 2009.

The Taoiseach, in exercise of the powers conferred on him by section 25(1) of the Statistics Act 1993 (No. 21 of 1993) and for the purpose of giving full effect to Regulation (EC) No 295/2008 of the European Parliament and of the Council of 11 March 2008 concerning structural business statistics (recast) 1 , hereby orders as follows:

1. This Order may be cited as the Statistics (Building and Construction Inquiries) Order 2009.

2. This Order applies to all persons and undertakings (other than public authorities) which are or were engaged in economic activities classified for statistical purposes under Section F of NACE Rev 2 (set out in Annex I to Regulation (EC) No. 1893/2006 of the European Parliament and of the Council of 20 December 2006 2 ), at any time during a year in respect of which a survey is undertaken.

3. (1) Persons or undertakings to which this Order applies are required to provide information, the general nature of which is specified in the Schedule, to the Central Statistics Office pursuant to surveys (the first of which shall be in the year 2009) of those persons or undertakings undertaken by that Office at intervals of not more than 12 months.

(2) The information referred to in paragraph (1) of this Article shall relate to the year immediately preceding that in which the relevant survey is undertaken.

SCHEDULE

Particulars of the business covered in the return.

Particulars of the accounting year covered by the return.

Particulars of the legal form by which the business is organised and of location of (ultimate beneficial) ownership.

Particulars of whether a family business or not.

Particulars of all local units operated by the business.

Particulars of the value of capital assets acquired and disposed of by the business during the year.

Particulars of the value of stocks and work in progress of the business at the beginning and end of the period concerned.

Particulars of purchases of materials, fuels and electricity.

Particulars of payments to sub-contractors.

Particulars of costs of other goods and services (excluding other labour costs).

Particulars of the turnover of the business, including breakdown for construction.

Particulars of indirect taxes paid or payable by the business.

Particulars relating to employment data, wages, salaries and gross earnings.

Particulars of other labour costs incurred by the business.

Particulars of payments to agency workers.

Particulars of percentage of work done classified by category of construction.

Particulars of Research and Development (R&D) activities engaged in by the business.

EXPLANATORY NOTE

(This note is not part of the Instrument and does not purport to be a legal interpretation.)

The purpose of this instrument is to enable a Statutory Inquiry into Building and Construction to be taken relating to the years 2008 to 2012, to define its scope and to require that returns be furnished to the Central Statistics Office covering all undertakings in respect of which the prescribed forms have been issued.
