CIVIL LAW (MISCELLANEOUS PROVISIONS) ACT 2008 (COMMENCEMENT) ORDER 2008

Notice of the making of this Statutory Instrument was published in

“Iris Oifigiúil” of 25th July, 2008.

I, DERMOT AHERN TD, Minister for Justice, Equality and Law Reform, in exercise of the powers conferred on me by section 1(2) of the Civil Law (Miscellaneous Provisions) Act 2008 (No. 14 of 2008), hereby order as follows:

1. This Order may be cited as the Civil Law (Miscellaneous Provisions) Act 2008 (Commencement) Order 2008.

2. In this Order “Act of 2008” means the Civil Law (Miscellaneous Provisions) Act 2008 (No. 14 of 2008).

3. (1) The 20th day of July 2008 is appointed as the day on which the provisions of the Act of 2008, other than those mentioned in paragraphs (2) to (4), shall come into operation.

(2) The 1st day of August 2008 is appointed as the day on which Part 2, other than sections 18, 20, 21 and 22, of the Act of 2008 shall come into operation.

(3) The 1st day of October 2008 is appointed as the day on which—

(a) sections 18, 20, 21 and 22 of the Act of 2008 shall come into operation, and

(b) section 3(1) of, and Part 1 of the Schedule to, the Act of 2008 insofar as they relate to the repeal, to the extent specified in column (3) of that Schedule, of the provisions of the Courts of Justice Act 1947 , the Courts of Justice Act 1953 , the Courts (Supplemental Provisions) Act 1961 , the Courts Service Act 1998 and the Courts and Court Officers Act 2002 shall come into operation.

(4) The 1st day of January 2009 is appointed as the day on which sections 34 and 39 and Part 6 of the Act of 2008 shall come into operation.

EXPLANATORY NOTE

(This note is not part of the instrument and does not purport to be a legal interpretation)

This Order commences the various provisions of the Civil Law (Miscellaneous Provisions) Act 2008 from a range of dates. Part 6 of the Act, which makes changes to the Juries Act (including removing the upper age limit for eligibility to serve on a jury and increasing the maximum fines for summary conviction of a range of offences under that Act) will come into effect on 1 January 2009. That date is also the commencement date for sections 34 and 39, dealing with the membership of Law Society committees. The provisions relating to the Rules Committees of the various courts come into effect on 1 October 2008. The other provisions that make changes in Courts legislation come into effect on 1 August 2008. The remaining provisions of the Act (which include changes to the law regarding solicitors, landlord and tenant, statutory declarations, bankruptcy, succession, video recordings, censorship of films, parental leave, Civil Service regulation, family law, equal status, civil legal aid and employment equality) come into effect on 20 July 2008.
