EUROPEAN COMMUNITIES (FEEDINGSTUFFS INTENDED FOR PARTICULAR NUTRITIONAL PURPOSES) (AMENDMENT) REGULATIONS, 2008

Notice of the making of this Statutory Instrument was published in

“Iris Oifigiúil” of 4th July, 2008.

I, BRENDAN SMITH, Minister for Agriculture, Fisheries and Food, in exercise of the powers conferred on me by section 3 of the European Communities Act, 1972 (No. 27 of 1972), for the purpose of giving effect to Commission Directive 2008/4/EC of 9 January 2008 1 hereby make the following Regulations:

1. These Regulations may be cited as the European Communities (Feedingstuffs Intended for Particular Nutritional Purposes) (Amendment) Regulations, 2008

2. The European Communities (Feedingstuffs Intended for Particular Nutritional Purposes) Regulations, 1996 ( S.I. No. 59 of 1996 ) are amended—

(a) in Regulation 2(1) by substituting for the definition of “the Directive” the following—

“‘ the Directive’ means Council Directive 93/74/EEC of 13 September 1993 2 , as amended by Commission Directive 94/39/EC of 25 July 1994 3 , Commission Directive 95/9/EC of 7 April 1995 4 , Commission Directive 95/10/EC of 7 April 1995 5 , Council Directive 96/25/EC of 29 April 1996 6 , Council Directive 99/78/EC of 27 July 1999 7 , Commission Directive 2002/1/EC of 7 January 2002 8 and Commission Directive 2008/4/EC of 9 January 2008;”

(b) in the Part B of the Schedule to the Regulations, the line of the particular nutritional purpose ‘reduction of the risk of milk fever’ is replaced by the following—

“ ‘Particular nutritional purpose

Essential nutritional characteristics

Other provisions

‘Reduction of the risk of milk fever’

— Low level of calcium

Dairy cows

- Calcium- Phosphorus- Magnesium

1 to 4 weeks before calving

Indicate in the instructions for use: “Stop feeding after calving”

and/or

- Low cations/ anions ratio

- Calcium- Phosphorus- Sodium- Potassium- Chlorides- Sulphur

1 to 4 weeks before calving

Indicate in the instructions for use: “Stop feeding after calving”

or

- High level of zeolite (synthetic sodium aluminium silicate)

Content of synthetic sodium aluminium silicate

The 2 weeks before calving

Indicate in the instructions for use:- “The amount of feed shall be restricted to ensure that a daily intake of 500g sodium aluminium-silicate per animal is not exceeded.”- “Stop feeding after calving”

or

- High level of calcium in the form of highly available calcium salts

Total calcium content, sources and respective quantity of calcium

Start at first signs of parturition to two days subsequent to parturition

Indicate on the package, container or label: — The instruction of use i.e. the number of applications and the time time before and after calving. — The text “It is recommended that a nutritional expert’s opinion be sought before use.”

(This is not part of the Instrument and does not purport to be a legal interpretation)

These Regulations amend the European Communities (Feedingstuffs Intended for Particular Nutritional Purposes) Regulations, 1996 so as to give effect to Commission Directive 2008/4/EC which amends the provisions applicable to the particular nutritional purpose “Reduction of the risk of milk fever”.
