DISEASES OF ANIMALS ACT 1966 (FOOT AND MOUTH DISEASE) (RESTRICTION ON IMPORTS FROM GREAT BRITAIN) (No. 2) ORDER 2007

Notice of the making of this Statutory Instrument was published in

“Iris Oifigiúil” of 14th September, 2007.

I, MARY COUGHLAN, Minister for Agriculture and Food, in exercise of the power conferred on me by sections 3 and 13 of the Diseases of Animals Act 1966 (No. 6 of 1966) (as adapted by the Agriculture, Food and Rural Development (Alteration of Name of Department and Title of Minister) Order 2002 ( S.I. No. 306 of 2002 )), hereby order as follows—

1. (1) This Order may be cited as the Diseases of Animals Act 1966 (Foot and Mouth disease) (Restriction on imports from Great Britain) (No. 2) Order 2007.

(2) In this Order—

“animal product” includes fresh meat, meat products, raw offal, semen, ova, embryos, raw milk and products derived from raw milk, fresh hides and skins, dung and manure of bovine, ovine, porcine and caprine animals and other biungulates;

“Minister” means the Minister for Agriculture and Food.

2. A person shall not import a bovine, ovine, porcine or caprine animal or other biungulate, or the carcase or an unprocessed animal product derived from such animal, from Great Britain either directly or across the land frontier save under and in accordance with a licence.

3. A person shall not have in his or her possession or under his or her control an animal, carcase or unprocessed animal product imported in contravention of Article 2.

4. (1) The Minister may grant a licence, attach conditions to the licence, vary a condition, revoke a licence or refuse an application.

(2) An application for a licence shall be in a form and contain such information as the Minister may determine.

5. A person importing a bovine, ovine, porcine or caprine animal or other biungulate, or the carcase or an unprocessed animal product derived from such animal, from Great Britain in accordance with Article 2 shall have the licence relating to the import in his or her immediate possession and shall produce it on request to an authorised officer.
