EUROPEAN COMMUNITIES (TRANSNATIONAL INFORMATION AND CONSULTATION OF EMPLOYEES ACT 1996) (AMENDMENT) REGULATIONS 2007

Notice of the making of this Statutory Instrument was published in

“Iris Oifigiúil” of 7th September, 2007.

I, MICHEÁL MARTIN, Minister for Enterprise, Trade and Employment, in exercise of the powers conferred on me by section 3 of the European Communities Act 1972 (No. 27 of 1972), and for the purpose of giving effect to Council Directive 2006/109/EC of 20 November 2006 1 , hereby make the following regulations:

1. These Regulations may be cited as the European Communities (Transnational Information and Consultation of Employees Act 1996) (Amendment) Regulations 2007.

2. Section 10(4) of the Transnational Information and Consultation of Employees Act 1996 is amended by substituting the following for paragraph (a):

“(a) subject to paragraphs (b) and (c), the Body shall have not less than 3 members nor more than such number of members as equals the number of Member States for the time being, elected or appointed in accordance with this Act;”.

EXPLANATORY NOTE

(This note is not part of the Instrument and does not purport to be a legal interpretation).

The purpose of these Regulations is to transpose into Irish law Council Directive 2006/109/EC of 20 November 2006 adapting Directive 94/45/EC on the establishment of a European Works Council or a procedure in Community-scale undertakings or Community-scale groups of undertakings for the purposes of informing and consulting employees, by reason of the accession of Bulgaria and Romania to the European Community.
