I, MICHEÁL MARTIN, Minister for Enterprise, Trade and Employment, in exercise of the powers conferred on me by section 3 of the European Communities Act 1972 (No. 27 of 1972), and for the purpose of giving effect to Council Directive 2006/109/EC of 20 November 2006 1 , hereby make the following regulations: | ||
1. These Regulations may be cited as the European Communities (Transnational Information and Consultation of Employees Act 1996) (Amendment) Regulations 2007. | ||
2. Section 10(4) of the Transnational Information and Consultation of Employees Act 1996 is amended by substituting the following for paragraph (a): | ||
“(a) subject to paragraphs (b) and (c), the Body shall have not less than 3 members nor more than such number of members as equals the number of Member States for the time being, elected or appointed in accordance with this Act;”. | ||

EXPLANATORY NOTE | ||

The purpose of these Regulations is to transpose into Irish law Council Directive 2006/109/EC of 20 November 2006 adapting Directive 94/45/EC on the establishment of a European Works Council or a procedure in Community-scale undertakings or Community-scale groups of undertakings for the purposes of informing and consulting employees, by reason of the accession of Bulgaria and Romania to the European Community. | ||
