SAFETY OF FISHING VESSELS REGULATIONS 2007

Notice of the making of this Statutory Instrument was published in

“Iris Oifigiúil” of 3rd August, 2007.

I, NOEL DEMPSEY, Minister for Transport, in exercise of the powers conferred on me by section 19 (inserted by section 47(1) of the Maritime Safety Act 2005 (No. 11 of 2005)) of the Merchant Shipping Act 1992 (No. 2 of 1992), hereby make the following regulations:

1. These Regulations may be cited as the Safety of Fishing Vessels Regulations 2007.

2. Subject to Regulation 3, the Minister may cause to be raised up from the sea bed any sunken fishing vessel and the vessel to be brought ashore, as directed by the Minister, for the purpose of examining the vessel.

3. The Minister may only exercise the power under Regulation 2 where he or she considers it necessary or expedient for any of the following purposes:

(a) ensuring the safety of fishing vessels or their crews;

(b) formulating, promoting or improving specified standards of seaworthiness, construction or maintenance of fishing vessels;

(c) determining specified life-saving, fire-fighting, or radio and navigation equipment to be carried on board fishing vessels or used by their crews;

(d) determining the adequacy of existing standards or specifications in relation to the matters mentioned in paragraphs (b) and (c) or the extent to which such standards are being complied with.

These Regulations enable the Minister to raise a sunken fishing vessel for examination for the purpose of ensuring the safety of fishing vessels and their crews.
