ROAD TRAFFIC (COMPONENTS AND SEPARATE TECHNICAL UNITS) REGULATIONS 2007

I, NOEL DEMPSEY, Minister for Transport, in exercise of the powers conferred on me by section 11 of the Road Traffic Act 1961 (No. 24 of 1961), the National Roads and Road Traffic (Transfer of Departmental Administration and Ministerial Functions) Order 2002 ( S.I. No. 298 of 2002 ) (as adapted by the Public Enterprise (Alteration of Name of Department and Title of Minister) Order 2002 ( S.I. No. 305 of 2002 )) and section 2 of the Road Traffic Act 2006 (No. 23 of 2006), and for the purpose of giving further effect to Council Directive 70/156/EEC of 6 February 1970 1 as last amended by Council Directive 2006/96/EC of 20 November 2006 2 , hereby make the following regulations:

1. These Regulations may be cited as the Road Traffic (Components and Separate Technical Units) Regulations 2007.

2. (1) In these Regulations—

“Framework Directive” means Council Directive 70/156/EEC of 6 February 1970 1 , as last amended by Council Directive 2006/96/EC of 20 November 2006 2 ;

“separate Directive” means a Directive listed in Annex IV to the Framework Directive taking account of the scope and latest amendment to each such Directive.

(2) A word or expression which is used in these Regulations and which is also used in the Framework Directive or a separate Directive has, unless the context otherwise requires, the same meaning in these Regulations as it has in the Framework Directive or relevant separate Directive.

3. (1) Where a component or separate technical unit is being purchased or fitted to a vehicle or trailer, such component or separate technical unit shall, if so required by a separate Directive at time of fitment to such vehicle, conform to a type which has been type-approved, bear any relevant type-approval mark and be fitted in accordance with the requirements of such separate Directive.

(2) In accordance with Part II of Annex IV to the Framework Directive, an approval issued under the Regulations of the United Nations Economic Commission for Europe shall be recognised as an alternative to type-approval granted under the relevant separate Directive.

EXPLANATORY NOTE

(This note is not part of the Instrument and does not purport to be a legal interpretation.)

The purpose of these Regulations is to transpose into Irish law provisions relating to the sale or entry into service of components or separate technical units, of

a. Council Directive 70/156/EEC of 6 February 1970 (as amended and updated) on the approximation of the laws of the Member States relating to the type-approval of motor vehicles and their trailers (known as the Framework Directive), and

b. a number of related Directives (known as separate Directives) which lay down the harmonised technical requirements applicable to individual parts and characteristics of motor vehicles.

The separate Directives to which these Regulations refer are included in the list of separate Directives which appears at Annex IV of the Framework Directive.
