Road Traffic Act 1994 (Control of Traffic - Exemption Permits) Regulations 2006

I, Martin Cullen, Minister for Transport, in exercise of the powers conferred on me by section 35(1) and (2)(t)(iii) (inserted by section 26 of the Road Traffic Act 2004 (No. 44 of 2004)) of the Road Traffic Act 1994 (No. 7 of 1994) and section 5(1) of the Road Traffic Act 1961 (No. 24 of 1961) and the National Roads and Road Traffic (Transfer of Departmental Administration and Ministerial Functions) Order 2002 ( S.I. No. 298 of 2002 ) (as adapted by the Public Enterprise (Alteration of Name of Department and Title of Minister) Order 2002 ( S.I. No. 305 of 2002 ), hereby make the following regulations:

1. These Regulations may be cited as the Road Traffic Act 1994 (Control of Traffic - Exemption Permits) Regulations 2006.

2. (1) A local authority may issue a permit to a person in respect of the driving of a mechanically propelled vehicle, which is prohibited or restricted -

(a) under Regulation 4 of the Road Traffic (Control of Traffic) Regulations 2006 ( S.I. No. 638 of 2006 ), or

(b) under bye-laws made under section 61 of the Roads Act 1993 (No. 14 of 1993),

from using a public road or road in a road tunnel in its functional area, exempting the permit holder, during the times (if any) specified in the permit, from the application of the prohibitions or restrictions, as specified in the permit, to such driving.

(2) The following charges are prescribed:

(a) with effect from 1 May 2007, a charge of €5,

(b) with effect from 1 May 2008, a charge of €6,

(d) with effect from 1 May 2010, a charge of €8,

(e) with effect from 1 May 2011, a charge of €9, and

(f) with effect from 1 May 2012, a charge of €10,

for each day of an exemption under a permit issued in respect of paragraph (1)(a).

(3) A nil charge is prescribed for a permit issued in respect of paragraph (1)(b) and until 1 May 2007 a permit issued under paragraph (1)(a).

EXPLANATORY NOTE

These Regulations (operative from 15 December 2006) prescribe the charge for the issue of a permit by a local authority in respect of a vehicle to which Regulation 4(1) of Road Traffic Act 1994 (Control of Traffic) Regulations 2006 ( SI No. 638 of 2006 ) applies and in respect of a vehicle that is prohibited from using a road tunnel under Toll Road Bye-laws made by a road authority under the Roads Act 1993 . The charges prescribed refer to 2007, 2008, 2009, 2010, 2011 and 2012.
