European Communities (Cosmetic Products) (Amendment No. 3) Regulations 2006

I, Mary Harney, Minister for Health and Children, in exercise of the powers conferred on me by section 3 of the European Communities Act 1972 (No 27 of 1972), for the purpose of giving effect to Commission Directive 2005/80/EC of 21 November 2005 hereby make the following Regulations:

1. These Regulations may be cited as the European Communities (Cosmetic Products (Amendment No. 3) Regulations 2006.

2. These Regulations shall be construed as one with the European Communities (Cosmetic Products) Regulations 2004 to 2006 and may be cited together with those Regulations as the European Communities (Cosmetic Products) Regulations 2004 to 2006.

3.   (1) Subject to paragraph (2), these Regulations shall come into force on 22 August 2006.

(2) The provisions of these Regulations, as they apply to those cosmetic products that fail to comply with the requirements for the placing of such products on the market by virtue of amendments contained in these Regulations, shall not apply to the sale or supply of cosmetic products to the final consumer until 22 November 2006.

4. In these Regulations “the Principal Regulations” mean the European Communities (Cosmetic Products) Regulations 2004 ( S.I. No. 870 of 2004 ).

5. The Principal Regulations are hereby amended by the addition to the definition of “Directive”, in Regulation 4(1) thereof, of the reference “2005/80/EC1 ”.

6. The Schedules to the Principal Regulations are hereby amended in the manner set out in the Schedule to these Regulations.

1.  Schedule 2 to the Principal Regulations is amended as follows: -

(a)  the entries under reference numbers 615 and 616 are deleted;

(b)  the entry under reference number 687 is replaced by the following:
