European Communities (Cosmetic Products) (Amendment No. 2) Regulations 2006

I, Mary Harney, Minister for Health and Children, in exercise of the powers conferred on me by section 3 of the European Communities Act 1972 (No 27 of 1972), for the purpose of giving effect to Commission Directive 2005/52/EC of 9 September 2005, hereby make the following Regulations:

1. These Regulations may be cited as the European Communities (Cosmetic Products) (Amendment No. 2) Regulations 2006.

2. These Regulations shall be construed as one with the European Communities (Cosmetic Products) Regulations 2004 and 2005 and may be cited together with those Regulations as the European Communities (Cosmetic Products) Regulations 2004 to 2006.

3. In these Regulations “the Principal Regulations” mean the European Communities (Cosmetic Products) Regulations 2004 ( S.I. No. 870 of 2004 ).

4. The Principal Regulations are hereby amended by-

(a)  the addition to the definition of “Directive”, in Regulation 4(1) thereof, of the reference “2005/52/EC1 ”;

(b)  the substitution in column g, in Part 2 of Schedule 3 thereto, of ‘31.8.2006’ for ‘31.12.2005’ in the case of substance reference numbers 1, 2, 8, 13, 15, 17, 23, 30, 34, 40, 41, 42, 43, 45, 46, 51, 52, 53, 54, 57, 59 and 60; and

(c)  the substitution in column g, in Part 2 of Schedule 3 thereto, of ‘31.12.2006’ for ‘31.12.2005’ in the case of substance reference numbers 3, 4, 5, 6, 7, 9, 10, 11, 12, 14, 16, 18, 19, 20, 21, 22, 24, 25, 26, 27, 28, 29, 31, 32, 33, 35, 36, 37, 38, 39, 44, 47, 48, 49, 50, 55, 56, and 58.

EXPLANATORY NOTE

( This note is not part of the Instrument and does not purport to be a legal interpretation )

The purpose of the Regulations is to update the law in relation to the manufacture, marketing and sale of cosmetic products by the implementation of Commission Directive 2005/52/EC.

The Regulations provide for an extension of the period during which certain hair dyes may continue to be used in cosmetic products. During this period, the additional information submitted by the industry will be examined by the EU Scientific Committee on Consumer Products (SCCP). In the meantime, the use of the hair dyes concerned continues to be permitted on a provisional basis subject to the restrictions and conditions laid down in Schedule 3, Part 2 of the principal Regulations.
