ORDER

entitled

Ministerial and Parliamentary Offices (Salaries and Allowances) (Increase) Order 2005


Made by the Government.

The Government, in exercise of the powers conferred on them by section 8A (inserted by section 11 of the Oireachtas (Allowances to Members) and Ministerial and Parliamentary Offices (Amendment) Act 1973 (No. 22 of 1973) and as amended by section 8 of the Ministerial, Parliamentary and Judicial Offices and Oireachtas Members (Miscellaneous Provisions) Act 2001 (No. 33 of 2001) (“Act of 2001”)) of the Ministerial and Parliamentary Offices Act 1938 (No. 38 of 1938) and section 11 (inserted by section 10 of the Act of 2001 of the Ministerial and Parliamentary Offices Act 1938 , hereby order as follows:

1.       (1)        This Order may be cited as the Ministerial and Parliamentary Offices (Salaries and Allowances) (Increase) Order 2005.

(2)        This Order comes into operation on 1 January 2006.

2.       In this Order-

“Act of 2001” means the Ministerial, Parliamentary and Judicial Offices and Oireachtas Members (Miscellaneous Provisions) Act 2001 (No. 33 of 2001);

“Principal Act” means the Ministerial and Parliamentary Offices Act 1938 (No. 38 of 1938).

3.       (1)        The salary payable under section 3(1) (inserted by section 3 of the Act of 2001) of the Principal Act is increased to a rate not exceeding-

(a)      in the case of the Taoiseach, €163,863,

(b)      in the case of the Tánaiste, €128,279, and

(c)      in the case of a member of the Government, other than the Taoiseach or the Tánaiste, €110,488,

in each year.

(2)        The salary payable under section 3(2) (inserted by section 3 of the Act of 2001) of the Principal Act to a Minister of State is increased to a rate not exceeding €48, 215 in each year.

4.       The salary payable under section 4 (inserted by section 4 of the Act of 2001) of the Principal Act to the Attorney General is increased to a rate not exceeding -

(a)      if the person who holds the office is not a member of either House of the Oireachtas, €199,044, or

(b)      if the person is a member of either House of the Oireachtas, €110,488,

in each year.

5.       The salary payable under section 5 (inserted by section 5 of the Act of 2001) of the Principal Act is increased to a rate not exceeding -

(a)      in the case of the Chairman of Dáil Éireann, €110,488, and

(b)      in the case of the Deputy Chairman of Dáil Éireann, €48,215,

in each year.

6.       The salary payable under section 6 (inserted by section 6 of the Act of 2001) of the Principal Act is increased to a rate not exceeding -

(a)      in the case of the Chairman of Seanad Éireann, €43,536, and

(b)      in the case of the Deputy Chairman of Seanad Éireann, €23,964,

in each year.

7.       The salary payable under section 6A (inserted by section 7 of the Act of 2001) of the Principal Act to the Leader of Seanad Éireann is increased to a rate not exceeding €19,025 in each year.

8.       The annual allowance payable under section 1 0 (inserted by section 1 of the Oireachtas (Ministerial and Parliamentary Offices) (Amendment) Act 2001 (No. 30 of 2001) of the Principal Act, is increased to an amount not exceeding in the case of the allowance mentioned at -

(a)      subsection (1)(a)(i) of that section, €63,215,

(b)      subsection (1)(a)(ii) of that section, €50,571,

(c)      subsection (1)(a)(iii) of that section, €25,293,

(d)      subsection (1)(b)(i) of that section, €41,335,

(e)      subsection (1)(b)(ii) of that section, €20,668,

(f)      subsection (3)(a) of that section, €36,374, and

(g)      subsection (3)(b) of that section, €20,668.

Explanatory Note

This Order applies increases with effect from 1 January 2006 to the salaries of Ministerial and Parliamentary office holders, arising from the recommendations in Report No. 40 of the Review Body on Higher Remuneration in the Public Sector, together with an increase in the sums payable to leaders of qualified parties and Independents in Dáil and Seanad Éireann with effect from 1 January 2006.
