IRISH AVIATION AUTHORITY (PROTECTED AREA) ORDER, 2005

S.I. No. 777 of 2005

The Irish Aviation Authority, being of the opinion that the unrestricted use of the area of land specified in Article 2 of this Order in the vicinity of the aerodrome known as Cork Airport would interfere with the navigation of aircraft flying to or from that aerodrome, and in exercise of the powers conferred on it by sections 5, 14 and 72 of the Irish Aviation Authority Act, 1993 (No. 29 of 1993) as amended, hereby orders as follows:

1.       (a)    This Order may be cited as the Irish Aviation Authority (Protected Area) Order 2005.

(b)    This Order shall come into operation on the 1st day of January 2006.

2.       (a)    It is hereby declared that the land specified in paragraph (b) of this Article shall for the purposes of this Order, be a protected area of 300 metres radius around the Doppler Very High Frequency Omni-Directional Radio Range and Distance Measuring Equipment which is sited at Ballygarvan and Lehenaghmore in the county of Cork in a position defined by the geographical co-ordinates 51° 50’ 26.2s North Latitude and 008° 29’ 39.4s West Longitude.

(b)    The land referred to in paragraph (a) of this Article is an area of land that is shown enclosed on the map annexed hereto within the inner margin of the black line and hatched thereon in black.

3.       It is hereby declared that, within the protected area, it shall not be lawful for any person, save under and in accordance with a permit granted by the Irish Aviation Authority:

(a)    to erect or add to any building, or

(b)    to erect or place any post, pole or other thing so that any part of the building, post pole or other thing will be at a height above ground level of greater than three metres.

EXPLANATORY NOTE

This Order establishes a protected area of 300 metres radius around the Doppler Very High Frequency Omni-Directional Radio Range and Distance Measuring Equipment which is sited at Ballygarvan and Lehenaghmore, Co. Cork. This equipment provides navigational information to aircraft flying to or from Cork Airport. The Irish Aviation Authority may grant permits where any proposed development within the protected area would not interfere with the navigation of aircraft flying to or from Cork Airport.
