CIVIL REGISTRATION (MARRIAGES) (FEES) REGULATIONS, 2005.

I, Mary Harney, Minister for Health and Children in exercise of the powers conferred on me by sections 4 and 9 of the Vital Statistics and Births, Deaths and Marriages Registration Act, 1952 (No. 8 of 1952), (as amended by the Social Welfare (Miscellaneous Provisions) Act, 2002 (No.8 of 2002)), with the consent of the Minister for Finance, make the following Regulations: —

1.         These Regulations may be cited as the Civil Registration (Marriages) (Fees Regulations, 2005.

2.         These Regulations shall come into operation on 5th December 2005.

3.         (a)  The amount of the fee for each certified copy of any entry in a register of marriages fixed by section 68 of the Marriages (Ireland) Act 1844 (as amended by the Social Welfare (Miscellaneous Provisions) Act, 2002 ) is altered to €8.

(b)  The amount of the fee fixed by section 69 of the Marriages (Ireland) Act 1844 (as amended by the Social Welfare (Miscellaneous Provisions) Act, 2002 ) for each certified copy of an entry or entries in the certified copy of the entries in the marriage registers reproduced under section 67A of the Marriages (Ireland) Act 1844 (inserted by the Social Welfare (Miscellaneous Provisions) Act 2002 ) is altered to €8.

(c)  The amount of the fee fixed by section 70 of the Marriages (Ireland) Act 1844 (as amended by the Social Welfare (Miscellaneous Provisions) Act, 2002 ) for each certified copy of an entry or entries in the certified copy of the entries in the marriage registers reproduced under section 67A of the Marriages (Ireland) Act 1844 (inserted by the Social Welfare (Miscellaneous Provisions) Act 2002 ) is altered to €8.

(d)  The amount of the fee fixed by section 17 of the Registration of Marriages (Ireland) Act 1863 (as amended by the Social Welfare (Miscellaneous Provisions Act, 2002 ) for each certified copy of an entry or entries in the certified copy of the entries in the marriage registers reproduced under section 15A of the Registration of Marriages (Ireland) Act 1863 (inserted by the Social Welfare (Miscellaneous Provisions) Act 2002 ) is altered to €8.

(e)  The amount of the fee fixed by section 18 of the Registration of Marriages (Ireland) Act 1863 (as amended by the Social Welfare (Miscellaneous Provisions Act, 2002 ) for each certified copy of an entry or entries in the certified copy of the entries in the marriage registers reproduced under section 15A of the Registration of Marriages (Ireland) Act 1863 (inserted by the Social Welfare (Miscellaneous Provisions) Act 2002 ) is altered to €8.

(f)  The amount of the fee fixed by section 19 of the Registration of Marriages (Ireland) Act 1863 for each certified copy of an entry or entries in the register of marriages is altered to €8.

4.         (a)  The amount of the fee for each particular search pursuant to sections 69 or 70 of the Marriages (Ireland) Act, 1844 (as amended by the Social Welfare (Miscellaneous Provisions) Act, 2002 ) fixed by each of the enactments to which this Regulation applies is altered to €2.

(b)  The amount of the fee for each particular search pursuant to sections 17 or 18 of the Registration of Marriages (Ireland) Act 1863 (as amended by the Social Welfare (Miscellaneous Provisions) Act, 2002 ) fixed by each of the enactments to which this Regulation applies is altered to €2.

(c)  The amount of the fee for each particular search pursuant to section 19 of the Registration of Marriages (Ireland) Act 1863 is altered to €2.

5.         The amount of the fee for each search fixed by section 68 of the Marriages (Ireland) Act, 1844 (as amended by the Social Welfare (Miscellaneous Provisions) Act, 2002 ) is altered to €2 for every search extending over a period of not more than one year and €1 for every additional year.

6.         The amount of the fee for each general search pursuant to (a) section 70 of the Marriages (Ireland) Act, 1844 (as amended by the Social Welfare (Miscellaneous Provisions) Act, 2002 ) or (b) section 17 of the Registration of Marriages (Ireland Act, 1863 (as amended by the Social Welfare (Miscellaneous Provisions) Act 2002 ) is altered to €20.

7.         The amount of the fee for each general search pursuant to (a) section 69 of the Marriages (Ireland) Act, 1844 (as amended by the Social Welfare (Miscellaneous Provisions) Act, 2002 ) or (b) section 18 of the Registration of Marriages (Ireland) Act, 1863 (as amended by the Social Welfare (Miscellaneous Provisions) Act, 2002 ) is altered to €10.

8.         For the purposes of regulations 4, 6 and 7, a “particular search” shall mean a search over any period not exceeding 5 years for any particular entry in a register and a “general search” shall mean a search, not exceeding seven consecutive hours, over any period exceeding 5 years. A “general search” conducted under regulation 7 refers to a search in the office of a Registrar or Superintendent Registrar while a “general search” conducted under regulation 6 refers to a search in the General Register Office.

9.         The amount of the fee for: —

(a)       each entry in the Marriage Notice Book fixed by section 14 of the Marriages (Ireland) Act, 1844 is altered to €40;

(b)       each certificate of an entry in the Marriage Notice Book fixed by section 16 of the said Act, is altered to €10;

(c)       each licence for marriage, fixed by section 21 of the said Act, is altered to €10;

(d)       entering a caveat against the grant of a certificate or a licence for a marriage fixed by section 23 of the said Act, is altered to €10;

(e)       each marriage solemnised in the presence of a Registrar of Marriages, fixed by section 31 of the said Act, is altered to €50 where the marriage is by licence and otherwise the sum of €50.

10.       The amount of the fee for each registered letter containing a copy of notice of intended marriage sent by the Registrar of Marriages fixed by section 3 of the Marriage Law (Ireland) Amendment Act, 1863, is altered to €3.

11.       (a)  The amount of the fee fixed for the registration of a place of public worship by each of the enactments to which this Regulation applies is altered to €75;

(b)  The enactments to which this Regulation applies are: —

sections 7, 27 and 28 of the Marriages (Ireland) Act, 1844;

section 12 of the Marriage Law (Ireland) Amendment Act, 1863.

The Minister for Finance consents to the making of the foregoing Regulations.

EXPLANATORY NOTE

The effect of this Order is to allow certain increases in the fees payable to (a) Oifig An Ard-Chláraitheora (b) Superintendent Registrars and (c) Registrars of Births, Deaths and Marriages for searches, certificates and other registration services in the matter of the civil registration of marriages.
