Companies (Fees) (No. 4) Order 2005

I, Michael Ahern, Minister of State at the Department of Enterprise, Trade and Employment, in exercise of the powers conferred on me by sections 395 (as amended by the Company Law Enforcement Act 2001 (No. 28 of 2001)) and 396 of the Companies Act 1963 (No. 33 of 1963) (as adapted by the Enterprise and Employment (Alteration of Name of Department and Title of Minister) Order 1997 ( S.I. No. 305 of 1997 )) and the Enterprise, Trade and Employment (Delegation of Ministerial Functions) (No.2) Order 2004 ( S.I. No. 808 of 2004 ), hereby order as follows:

1.   This Order may be cited as the Companies (Fees) (No. 4) Order 2005.

2.   This Order shall come into operation on 1 December 2005.

3.   In this Order “Eighth Schedule” means the Eighth Schedule (substituted by the Companies (Fees) (No.3) Order 2005 ( S.I. No. 517 of 2005 )) to the Companies Act 1963 (No. 33 of 1963).

4.   Part I of the Eighth Schedule is altered by adding the following to the Table of Fees therein:

 

For registration of a notification to the registrar pursuant to section 57(4)(a) of the Investment Funds, Companies and Miscellaneous Provisions Act 2005 that the company has authorised an electronic filing agent

For registration of a notification to the registrar pursuant to section 58(2) of the Investment Funds, Companies and Miscellaneous Provisions Act 2005 that the company has revoked the authorisation of its electronic filing agent

EXPLANATORY NOTE

(This note is not a part of the Instrument and does not purport to be a legal interpretation)

This Order lays down the fee to be paid in respect of the filing of Form B77 (notification to the registrar of companies of the appointment/revocation of appointment of an electronic filing agent by a company), and makes separate provision for the fee payable in respect of a paper notification and the fee payable in respect of an electronic notification.
